The National Police appealed to netizens not to distribute videos of sex scenes called ‘Gisel-like’ descriptions. Police have warned in criminal terms those who have been shown to have shared the video for 6 years.
“Of course, we urge the public not to share because the video contains pornographic elements,” said Karo Penmas, Police Public Relations Division, Brigadier General Awi Setiyono. detikcom, Saturday (7/11/2020).
Awi explained that the prohibition to distribute pornographic content is contained in article 27 paragraph (1) of the ITE Law. The article says: ‘Anyone who knowingly and without rights distributes and / or transmits and / or makes accessible Electronic Information and / or Electronic Documents that contain content that violates decency.’
“The ban is in Article 27,” Awi said.
Awi later transmitted that the punishment for offenders is regulated in article 45 paragraph (1) of Law Number 19 of 2016 on Amendments to Law Number 11 of 2008 on ITE. The article says: ‘Any person who, knowingly and without right, distributes and / or transmits and / or makes accessible Electronic Information and / or Electronic Documents that have contents that violate the decency referred to in Article 27 paragraph (1) will be sentenced to prison. a maximum of 6 (six) years and / or a maximum fine of 1,000 million rupees. ‘
“The threat of punishment is regulated in article 45 paragraph 1 of the ITE Law. Where the maximum penalty is up to 6 years in prison,” Awi said.
Previously, in the video that was circulating, it was seen that a woman who was said to be a netizen was similar to Gisel having sex with a man.
The intercourse took place in a room with the television still on. There were also visible brown curtains in the room.
So far, Gisel has not provided any clarification on the video.
Gisel’s attorney, Sandy Arifin, who used to handle a similar case, finally opened his voice on this matter. He said he still couldn’t reach Gading Marten’s ex-wife because she was out of town.
