He recently announced the Cipta Kerja Omnibus Law, which regulates working hours. It is no exception when employees have to work longer working hours, that is, overtime.

The revision of article 78 of this Law establishes that there are conditions that must be met if workers have to work overtime. In paragraph 1 point a of the Omnibus Law on Cipta Kerja, it is established that overtime must be based on an agreement between the worker and the company.
Then the overtime is also limited, a maximum of 4 hours a day. Meanwhile, only a maximum of 18 overtime hours is allowed in a week.
Then, paragraph 2 explains that the company is required to pay overtime compensation if a worker is forced to work beyond normal working hours.
“Employers who employ workers / day laborers for more than the working hours referred to in paragraph (1) must pay wages for overtime,” says Article 78 paragraph 2 of Law 11 of 2020.
Then in paragraph 3 of article 78 it is mentioned that the provision of hours of work or overtime does not apply to some business sectors.
“The overtime provision referred to in paragraph 1) letter b does not apply to certain commercial or labor sectors”, says paragraph 3 of article 78.
Meanwhile, other provisions relating to certain commercial sectors, as well as the payment of overtime, will be regulated in a government regulation.
The hours of work themselves are regulated in an amendment to article 77. In paragraph 2 of article 77, it is established that companies can choose two options of hours of work. Both options establish that the maximum working day in a week is 40 hours.
The first option of working hours is set to 6 working days a week, per day a maximum of 7 hours. Then, the second option, mentioned the working day is a maximum of 8 hours with a working day of 5 days a week.
