PT Hanson International Tbk Commissioner Benny Tjokrosaputro was sentenced to life in prison. Benny was found guilty of corruption and enriched himself in collaboration with three former Jiwasraya officials worth Rs 16 trillion.

“At trial, stating that it was legally and convincingly demonstrated that the defendant committed the criminal act of corruption together and committed the crime of money laundering,” the head of the judging panel, Rosmina, said on Monday in the Central Court from Jakarta, Jalan Bungur Besar Raya, Central Jakarta, on Monday (10/26/2020).

“He sentenced the defendant Benny Tjokrosaputro to life imprisonment,” added Rosmina.

Benny violates article 2, paragraph 1 together with Article 18 paragraph (1) letter b, paragraph (2) and paragraph (3) of Law No. 31 of 1999 on the Eradication of Criminal Crimes, amended by Law No. 20 of 2001 on Amendments to Law No. 31 1999 on Eradication of Corruption together with Article 55 paragraph (1) 1 of the Penal Code.

Benny also had to pay a replacement fee of Rs 6,078,500,000,000. If the defendant does not pay for a replacement within 1 month after the final decision, the prosecutor will auction the property to replace the replacement money.

The judge said Heru Hidayat and Benny Tjokro were found guilty of corruption along with former PT Asuransi Chairman Jiwasraya Persero Hendrisman Rahim, PT Asuransi former CFO Jiwasraya Hary Prasetyo, former PT Asuransi Finance and Investment Division chief Jiwasraya Syahmirwan and businessman Joko Tirto Hart. Benny Tjokro and Heru are said to have paid bribes and gratuities to Hendrisman et al with respect to investment in PT AJS stocks and mutual funds in 2008-2018.

“That the defendants Benny Tjokrosaputro and Heru Hidayat have delivered a series of actions to Hendirsman Rahim, Hary Prasertyo and Syahmirwan,” said the judge.

The judge also said that the actions of Benny Tjokro et al had caused losses to the state. Total state losses reached Rs 16 trillion.

“State losses on equity investments amounting to Rp 4,650,283,375,000, and state losses on investments in mutual funds amounting to Rp 12,157 billion, so that the total state losses as a whole are Rp 16,807,283,375,000, 00 billion. Whereas the panel of judges is of the opinion that the state losses have been proven legally and convincingly, “said the judge.

In addition, the judge said that the actions of Benny Tjokro and Heru Hidayat with Hendrisman Rahim et al and Joko Hartono Tirto in relation to the control of the actions of Jiwasraya were shown to be contrary to the law.

“Considering that there are previous considerations, it has been proven that there is an intention or mens rea between Hendrisman Rahim, Hary Prasetyo, Syahmirwan, Joko Hartono Tirto, Heru Hidayat and the defendant Benny Tjokrosaputro and other parties with the same intention to play their respective roles to invest in PT AJS against the law, ”said the judge.

“Therefore, the defendant Benny Tjokrosaputro was the person who participated in the o co-author, so that the elements that do it and participate in doing it have been tested ”, he added.

In addition, Benny was also found to have committed the crime of money laundering (TPPU). Benny concealed his assets related to the proceeds of corruption by purchasing various assets.

“Considering that based on legal facts, the assembly believes that in the act the element of placement, transfer, transfer, expense, payment, granting, bringing abroad, change of forms, exchange of currency or values ​​or other actions has been verified on property, the defendant Benny Tjokrosaputro, ”said the judge.

The act of money laundering that both carried out was disguised by buying land to buy and sell shares. He also bought apartments and built houses.

Regarding TPPU, Benny violated article 3 of Law No. 8/2010 on Prevention and Eradication of the Crime of Money Laundering.
