Jakarta, CNBC Indonesia – The defendant of a criminal offense in PT Asuransi Jiwasraya (Persero), Benny Tjokrosaputro, gave his statement in the follow-up trial held in the Central District Court of Jakarta, on Thursday night (10/22/2020).

In his defense note, Bentjok said, the life sentence imposed on him was an injustice.

Because, according to him, the testimony of the witnesses at the trial could not prove that he was the one who regulated or controlled Jiwasraya’s investments in both mutual funds and stocks.

“I am just a businessman who has always tried to keep my company running and to be able to support thousands of my employees and their families all this time, and help the national economy,” he said.

“That the charges and accusations against me constitute a conspiracy to catch me as the author of a criminal act of corruption that occurred in PT AJS. That is, I am the victim of the conspiracy of certain parties that are really responsible for the loss of this status”, continuous.

As he emphasized again, the conspiracy was carried out with certain scenarios by people who used power in the name of the law.

“To seize my assets to cover up the wrongdoings of other people, which are said to have caused a loss of 16.8 trillion rupees in state finances,” he said.


In his personal statement, he also mentioned the name of Grupo Bakrie.

“My position in relation to PT. Jiwasraya Insurance is similar to the position of Bakrie Group, similar but not the same. The difference is that I made a loan in PT. Asuransi Jiwasraya at the end of 2015 and then I paid everything back in 2016, while the Bakrie Group signed a REPO Agreement before 2008 with a value of trillions of rupees and until now it remains in the portfolio of PT. AJS and even then the REPO was re-performed to PT. AJS and so far it has not been exchanged ”, He added.

As is well known, the prosecutor demands life imprisonment and a fine of 5,000 million rupees, a subsidiary for 1 year in prison and 6.07 trillion rupees in compensation.

At last week’s trial on Thursday (10/15/2020), the prosecutor claimed that Bentjok was legally and convincingly found guilty of committing a criminal act of corruption together.

This is in accordance with Article 2 Paragraph 1 in conjunction with Article 18 paragraph (1) letter b, paragraph (2) and paragraph (3) of Law Number 31 of 1999 on the Eradication of Crimes of Corruption, as amended by the Law Number 20 of 2001 relating to Law Number 31 of 1999 on the Eradication of Corruption, in conjunction with article 55 subsection 1) of the Penal Code and article 3 of Law Number 8 of 2010 on the Prevention of Money Laundering (TPPU).

“If the defendant does not pay the replacement money within 1 month after the court’s decision, the prosecutor will confiscate the property and it will voluntarily become the replacement money,” the prosecutor said when reading the charges, Thursday (15 / 10/2020).

“If the convict is found guilty and sentenced in addition to life or death, and the convict does not have enough assets to pay, he will be replaced by a 10-year prison term.”
