Pollycarpus Budihari Prijanto passed away in a positive condition from the Corona virus (COVID-19). The man born in 1961 is an ex-convict in the murder case of human rights activist Munir Said Thalib.

Summarized detikcom, Saturday (10/17/2020), Pollycarpus is a senior pilot for Garuda Indonesia Airline. His name is known to the public due to the Munir murder case.

Munir died on a Garuda plane with the number GA-974 while en route to Amsterdam to continue his graduate studies on September 7, 2004. Pollycarpus was initially questioned as a witness.

The Dutch Forensic Institute (NFI) proved that Munir died of arsenic poison in a fatal dose. Apparently Munir’s murder was carried out by poisoning his food.

Pollycarpus was on the same plane as Munir. It is believed to be just a facilitator. When the incident occurred, Pollycarpus was not on duty. The chair Munir took was originally Pollycarpus’s seat.

To Munir, Pollycarpus offered to change seats. Because of this, Pollycarpus was arrested and named a suspect on March 18, 2005. Pollycarpus was charged with first-degree murder.

Aside from Pollycarpus, two members of Garuda’s crew have been named suspects in the Munir case. The two people are a crew pantry named Oedi Irianto and a flight attendant named Yeti Susmiarti.

Garuda’s former managing director, Indra Setiawan, was also found guilty by the court of assisting in the murder of the human rights figure. Indra designed it in such a way that Pollycarpus could board a Garuda plane from Singapore-Holland. In the sky over Thailand and Sri Lanka, Munir drank a drink that had been mixed with arsenic until he died. Indra was sentenced to 1 year in prison.

In this case, Muchdi Pr was also named a suspect as the deputy head of the State Intelligence Agency (BIN). He is strongly suspected of being involved in the premeditated murder of human rights activist Munir. However, on December 31, 2008, Muchdi was acquitted by the South Jakarta District Court.

The man who was born in Surakarta was later sentenced to life in prison on December 1, 2005. However, in the end, the Central District Court of Jakarta (PN) sentenced Pollycarpus to 14 years in prison. He was convicted of the premeditated murder of Munir by putting arsenic poison in the fried noodles that Munir ate on the flight to Singapore.

Munir Said Thalib's wife Suciwati along with KontraS and human rights activists packed the courtroom of the Public Information Commission (KIP) in Jakarta on Monday (10/10/2016). They brought a paper holder with Munir's photo while they waited for KIP's decision to find out whether the Fact-Finding Team (TPF) document on Munir's case should be made public or not. So far, the findings of the TPF Munir case are still closed and have not been made public.Illustration by Munir Said Thalib (Ari Saputra / detikcom)

Pollycarpus then filed an appeal. In March 2006, the DKI Jakarta High Court upheld the decision of the Jakarta Central District Court by continuing to sentence him to 14 years in prison.

At the cassation level, the Supreme Court (MA) issued a judgment in which it stated that it was not proven that Pollycarpus had committed the crime of premeditated murder against Munir. Polly was only found guilty of using forged documents to travel. Polly was only sentenced then to 2 years in prison.

Then, on November 3, 2006, Pollycarpus was executed and sent to Cipinang Prison. He was then released from Cipinang Prison after receiving an additional 2-month referral and a one-month special referral on December 25, 2006.

The case continues. In January 2007, the Supreme Court granted PK’s request submitted by the prosecutor in relation to the murder of human rights activist Munir. Polly was sentenced to 20 years in prison. He said he filed a PK on PK’s decision.

The Supreme Court then granted Polly’s PK by reducing Pollycarpus’s sentence from 20 years to 14 years in prison on October 2, 2013. After serving an 8-year prison term, he was declared on probation since October 28. November 2014.

Pollycarpus was reported to have joined the Berkarya Party in 2018, which was later led by Tommy Soeharto. Pollycarpus is said to have joined Berkarya with Muchdi Pr.

“We don’t want to see people’s backgrounds. The important thing is to become members, please,” Berkarya Party Secretary General Badaruddin Andi Picunang said on Tuesday (6/3/2018).

Picunang stated that Pollycarpus could have the same vision and mission as the Berkarya Party. According to him, Pollycarpus has the same political rights as other Indonesian citizens.

“Everyone has the political right to channel their aspirations. Perhaps he sees the Berkarya Party as able to channel their political aspirations. We do not limit it, the important thing is that they meet the requirements, right? You have the same voting rights, a Pollycarpus and a president have the same vote, “he explained.

Aside from the question of joining Berkarya, there was not much news about Pollycarpus after being released from Sukamiskin Prison. Polly was declared pure free on August 29, 2018. The party answered Polly’s question of being pure free.

Cabinet secretary Pramono Anung said the problem faced by the former Garuda Indonesia pilot was purely legal. Pollycarpus has been found guilty.

“The Pollycarpus problem is a purely legal issue, and he has already been convicted. This means that the action he committed was guilty and then the sentence was handed down by the judge and also inconsiderate,” Pramono said in his office, Secretariat building State, Jakarta, on Wednesday (8/29/2018).

Because this is a legal issue, Pramono said, the executive, in this case the government, cannot intervene in the law. “Because this is the domain of the judiciary and the restraining authority is also the judiciary. Because this country, which currently has three judicial, executive and legislative institutions, is truly independent so people must respect the legal process in yes, “he said.
