At 10:46 p.m. WIB on Thursday night, the prosecutor read Heru Hidayat’s demands.


Claim that Heru Hidayat was found guilty of the commission of the collective crime of corruption and money laundering (TPPU).

This is as in the primary indictment 1 Article 2 Paragraph 1 in conjunction with Article 18 paragraph (1) letter b, paragraph (2) and paragraph (3) of Law Number 31 of 1999 on the Eradication of Crimes of Corruption, modified by Law Number 20 Year 2001 on the Amendments to Law 31 of 1999 on the Eradication of Corruption in conjunction with article 55 paragraph (1) first of the Penal Code and article 3 of Law paragraph 1 Letter C of Law No. 15 of 2002 on TPPU.

He sentenced the defendant Heru Hidayat to life imprisonment and a fine of Rs 5,000 million, a subsidiary of 1 year in prison on order that the defendant remain in detention.

Replacement money paid of 10 billion 728 billion 783 375 thousand rupees (Rp 10.728 billion).

If the defendant Heru Hidayat does not pay the replacement money within 1 month after the permanent court decision, the prosecutor can confiscate the defendant’s property and cover the replacement money.

If the defendant does not have enough assets to pay the replacement fine, he will be sentenced to 10 years.

“Things that are burdensome, that is, not supporting the government in the eradication of corruption, then huge state losses of 16 trillion 877 billion 283 million 375 thousand rupees, and the defendant did not admit his actions,” said the prosecutor, upon reading the charges.

Meanwhile, the amount of compensation in Heru’s final claim of Rp. 10,728 billion was greater than the claim at the time of the initial reading by the prosecutor.

Previously, in the preliminary reading of the lawsuits, the prosecutor asked both Heru and Bentjok to return the state’s losses that had reached trillion rupees, reaching Rp.12,157 billion, each of Rp.6,078 billion.

“Benny Tjokrosaputro and Heru Hidayat have enriched themselves with 12 trillion 157 billion. Therefore, the defendants Benny Tjokrosaputro and Heru Hidayat must compensate the losses of the state of 6 billion 78 thousand 500 million each,” said the prosecutor.

With the change in Heru’s compensation figure of Rs 10,728 trillion, plus a Bentjok compensation of Rs 6,078, the total compensation for both reached Rs 16.81 trillion.

This amount is the same as the total potential state loss as calculated by the Higher Audit Agency (BPK), ie 16.81 trillion rupees.

For information, Heru is the Commissioner of Trada Alam Minera and also of PT Inti Agri Resources Tbk (IIKP).

For Bentjok, the claim was also read first by the JPU.

JPU stated, the defendant Benny Tjokrosaputro legally proven and convincingly guilty of having committed a criminal act of corruption together.

This is in accordance with Article 2 Paragraph 1 in conjunction with Article 18 paragraph (1) letter b, paragraph (2) and paragraph (3) of Law Number 31 of 1999 on the Eradication of Crimes of Corruption, as amended by Law Number 20 of 2001 on modifications. of Law Number 31 of 1999 on the Eradication of the Crime of Corruption, in conjunction with Article 55 paragraph (1) 1st. COW Penal Code and article 3 of Law No. 8 of 2010 on TPPU.

He sentenced the defendant to life imprisonment on the defendant’s order to remain in a state detention center.

He paid a fine of IDR 5 billion, a subsidiary for 1 year in prison.

Other than that, Bentjok He also asked to pay replacement money of 6 billion 78 billion 500 million (Rp 6.078.5 billion).

“If the defendant does not pay the replacement money within 1 month after the court’s decision, the property is confiscated by the prosecutor and he is willing to become the replacement money,” he said. JPU.

“If the convict is found guilty and sentenced in addition to life or death, and the convict does not have sufficient assets to pay, he will be replaced by a prison term of 10 years.”

Earlier, on October 12, the charges were read to four other Jiwasraya defendants with the maximum penalty, namely life imprisonment.

First, former CEO of Jiwasraya, Hendrisman Rahim, was found guilty of corruption by enriching himself and Benny Tjokro et al worth Rs 16 trillion and sentenced to life imprisonment.

Second, former Chief Financial Officer Jiwasraya, Hary Prasetyo, was also sentenced to life imprisonment.

Third, former head of the Jiwasraya Investment and Finance Division, Syahmirwan, was sentenced to life imprisonment for the Jiwasraya corruption scandal.

The verdict against Syahmirwan heavier than demand JPU previously, namely, 18-year prison and a fine of Rs 1,000 million.
