Praka P and Pratu M then went to a hotel in the Ungaran area, Semarang, and in that room Praka P again practiced sodomy with Pratu M. The relationship was made several times.

The TNI leadership, who knew that the movement was not normal, immediately examined Praka P. Finally, Praka P was tried for his homosexual act.

In the indictment, Praka P was charged with violating article 103, paragraph 1, of the Military Penal Code, that is, disobeying official orders. The order of service in question is the TNI commander’s telegram letter number ST / 1648/2019 dated October 22, 2019, on the prohibition of TNI and PNS soldiers and their families from having relationships with people from the same sex.

A similar telegram was also issued by the Chief of Staff of the Army with number ST / 2694/2019 dated September 5, 2019 regarding the application of the law in a firm, measurable and proportional manner to individual soldiers and public officials of TNI AD involved in cases of same-sex relationships.

What did the panel of judges of the Military Court say?

“To declare that the aforementioned defendant was legally and convincingly guilty of committing a crime of deliberate disobedience. Main offense: imprisonment of 1 (one) year. It was determined that while the defendant was detained, the entire sentence was deducted. additional: dismissal from Military service ”, said the verdict presided over by Lieutenant Colonel Chk Eddy Susanto SH with members of Major Chk JOkor Trianto SH MH and Major Chk Victor Virganthara Taunay SH.

According to the panel, the defendant engaged in deviant same-sex sexual behavior, despite the defendant being a TNI soldier who should have been an example of behavior for the community in the defendant’s environment. Mainly obeying the rule of law.

“So the Defendant’s actions violated the rules of law and legislation, as well as the provisions of religious norms, so firm action must be taken,” explained the panel’s decision.

The Assembly stated that in the TNI environment, orders from superiors must be obeyed and obeyed in the performance of their duties and in their daily behavior as TNI soldiers. Their goal is to create attitudes, behaviors and actions as TNI soldiers with dignity and to maintain self-respect.

The order in question is the prohibition for TNI soldiers to have sex with the same sex (homosexual / lesbian), legal sexual relations outside of marriage, living with a woman / man without a legal basis for marriage.

“The defendant had heard the emphasis both during the morning rally and during the commander’s hour, but the defendant never paid attention to this matter and the defendant engaged in deviant same-sex sexual behavior,” the panel said.

The above decision is in line with the mandate of the Vice President of the Supreme Court of Military Affairs of the Armed Forces of TNI Burhan Dahlan. Burhan asked the military judges not to hesitate to fire TNI members who have a lesbian, gay, bisexual and transgender (LGBT) sexual orientation.

“There is no need to make a life like this,” Burhan said.
