Panel of judges of the State Administrative Court (PTUN) Bandung granted the lawsuit convicted of violence against children, Bahar bin smith, related to the revocation of assimilation by the Bogor Class II Correctional Center (Bapas).
This was directly confirmed by Bahar Smith’s attorney, Aziz Yanuar, on Monday (12/10).
“Today the Bandung Administrative Court decided that our claim of Habib Bahar bin Smith was fully accepted. Habib Bahar bin Smith must return his assimilation, be able to assimilate again, so that he can return home,” Aziz told CNNIndonesia.com by voicemail.
Based on this decision, the Bapas Decree (SK) that revoked the assimilation of Bahar was invalid. Therefore, the right of assimilation must be returned to Bahar.
Aziz asked the government, in this case the General Directorate of Corrections, Ministry of Justice and Human Rights, to comply with the decision.
“We ask the government to obey the rule of law and be consistent with judicial decisions,” he said.
Meanwhile, the head of Public Relations and Protocol of the PAS General Directorate, Rika Aprianti, said that she will not yet execute the verdict because she plans to appeal to the Superior Administrative Court of the State (PTTUN).
“Our position is still on appeal,” Rika said in a written message released by the Public Relations Ministry for Law and Human Rights.
Previously, Bahar’s team of lawyers assessed that Bapas Bogor’s revocation of assimilation seemed subjective because his client did not violate Large Scale Social Restrictions (PSBB) regarding crowds during the conference.
Aziz claims that the crowd was beyond his client’s control.
“Because of its size they accused Bahar of violating the PSBB, even though what was done was out of Bahar’s control. We also compared it to the Pancasila Concert that took place at that time, it was just a warning. That means that there is no equality before the law, “Azis said.
Apart from that, Aziz also conveyed that he did not accept Bahar’s allegations, which were seen as provocative speeches. The reason, he continued, was that his client did not explicitly mention who he was referring to at the conference.
Bahar was released on parole thanks to the Pondok Rajeg prison assimilation program on May 16. The Assimilation Program is a training process for inmates that is carried out by integrating inmates into the life of the community. After being released, Bahar immediately gave a lecture at Tajul Alawiyyin Islamic Boarding School, Kemang, Bogor Regency.
Bahar’s right of assimilation was revoked because he failed to comply with the call to keep his distance amid the Covid-19 virus pandemic. At the time, the residents who were following Bahar’s lecture were very close together, keeping no distance between them.
