JAKARTA, KOMPAS.com – The existence of the final draft of the copyright bill for the works so far is not clear. In fact, the Labor Creation Bill was ratified through the plenary session of the DPR on October 5, 2020.

The document presented by Awi is entitled “Draft Law 5 OCT 2020 on Job Creation-Full”. The document is 905 pages long.

Launch of a new version

Not only that, today Monday (12/10/2020), the draft Law on Intellectual Property of Works with the latest version also circulated.

This time, there is a 1035 page draft. On the last page, there is a column for the signature of DPR leader Aziz Syamsuddin.

Interestingly, this draft is circulating among academics and journalists under the storage name “Draft CIPTA KERJA – SEND TO PRESIDENT.pdf”.

Until now, it is not known with certainty about the initial source of the preliminary version of the Draft Law for the Creation of Works.

There has been no response or confirmation from DPR leadership or DPR Baleg regarding the latest version of the Job Creation Bill.

Several different versions have made the final draft of the Works Creation Bill even more confusing.

Previously, it was revealed that there was no final draft of the Job Creation Bill. So what document was approved by DPR?

A member of the Legislature Corps of the Golkar faction, Firman Soebagyo, on Thursday (10/8/2020) stated that DPR is still improving the job creation bill.

He also said that the draft that was circulating was not final and he was concerned that the script would provoke people.

“It means that this draft is not being discussed at the same time as a final one, there are still processes that are gradually being refined,” said Firman.

A DPR member from the PKS faction, Mulyanto, revealed that all council members did not receive the final draft of the Job Creation Bill during the plenary meeting for ratification.

“Then, in the middle of the plenary session, the draft of the material (Employment Creation Law) was not in the hands of the members. Until today it has not been sent and the members have not seen the articles,” Mulyanto said in a discussion online, Thursday (8/10/2020).

Awi did not deny the members’ statements. He agreed that DPR Baleg was still reviewing the draft Employment Creation Law.

However, he emphasized, the corrections made were limited to typographical errors or repetitions of words.

“We have told you, we asked for the time to give me the opportunity to Baleg-review Again, I’m afraid there is a wrong period, wrong letter, wrong word, or wrong comma. We cannot change the substance because it has been decided, “Awi said when contacted on Thursday (10/8/2020).

This means that, according to Awi, the correction is limited to the editorial, not the background.

Awi said editorial corrections to the bill that passed in plenary were normal.

At the same time, he denied that the errors were caused by the hasty discussion and approval of the Bill for the Creation of Works.

According to him, based on article 72 subsection 2 of Law Number 12 of 2011 on the Formation of Legislative Regulations, the DPR has a maximum period of seven days after the ratification date to present the bill to the president.

In addition, the bill will be automatically approved within 30 days of the ratification date with or without the president’s signature.

“In the ratification of the bill, everyone has the opportunity to make corrections. Not to change the background. Also, our discussion of this law is limited by time, that is, three sessions. So it has to be ratified. But it’s already finished, unless it’s not finished then it’s problematic, “he said. Awi.

In addition, the general secretary of the DPR, Indra Iskandar, explained that in the DPR regulations there is no obligation to distribute the final draft of the bill to all members during the discussion in plenary.

According to him, the bill had been agreed by all factions with the government to make level I decisions.

Three different drafts

Meanwhile, on the DPR website (dpr.go.id), the uploaded draft of the Job Creation Bill is also different from the one that Awi distributes to journalists or the draft circulating this Monday.

The Works Creation Act documents uploaded to the DPR website are 1028 pages long, but have no clear date.

Therefore, there are at least three versions of the draft Law for the Creation of Works, with a total of 905 pages, 1035 pages and 1028 pages.

However, so far the DPR has also not given any indication that the Job Creation Bill has been approved in a plenary session.

According to the draft discussion flow chart on the DPR website, the Job Creation Bill has only reached the level I conversations stage.

In fact, if reference is made to Law 12/2011, today is exactly seven days after the date of approval of the Draft Law on Intellectual Property for Works.

When contacted, Awi only responded briefly, the seven days referred to in the Law, that is, seven working days.

“Seven business days. Try to confirm with the DPR management,” Awi said.
