The content of the letter from the Unisba Chancellor to the West Java Police Chief:

Following up on the previous letter on the demonstration of students from various universities (including Unisba students) on October 7 and 8, 2020, which was guaranteed by Law No. 9/2008, and the tear gas shooting incident at the Unisba campus area that caused damage With respect to the Unisba security facility, as well as the beating of individual police officers against security personnel on our campus, through this letter we convey regret and various statements.

1. Whereas the actions of a small number of police officers who handled student protests (including Unisba students) who carried out excessive actions (excessive force) that caused damage to campus facilities were in fact an act that was not appropriate for law enforcement officers to carry out their duties because campus facilities were not. there is something to do with the object of the police action.

2. Whereas law enforcement officials (in case of police) should also pay attention to the code of conduct for law enforcement, one of which is when a law enforcement officer uses force (when strictly and only to the extent required for the performance of their duty). Then you also have to pay attention to the basic principles on the use of force and firearms by law enforcement officers and the Code of Criminal Procedure. Based on these legal instruments, vandalism of campus facilities and beatings of campus security members are not justified because the police are not in danger of life.

3. That we deeply regret and ask the attention of the Police leadership so that the practice of police action does not become a habit and is considered as an ordinary action because it is not in accordance with the functions and duties of the police that protect and protect the community.

4. After there has been an agreement with the Unisba Foundation, we also understand that in modern criminal law doctrine such practice is called an out-of-court settlement. Therefore, for the existence of equality before the law and the performance of such practices, we urge the police to apply it to all students of any tertiary institution who, up to now, are still in judicial process in the police.

5. We also believe that the police will continue to be Rasta Sewakottama (servant of the state and servant of the state) and will adhere to article 13 of Law No. 2 of 2002 on Police, which explicitly states that the main duty of the police is to maintain public security and order, both law enforcement agencies and third parties provide protection, protection and service to the community.

6. Unisba as a component of the nation will continue to fulfill its role as an institution of higher education that together with other national components will jointly educate the life of the nation.
