Bisnis.com, JAKARTA – Attorney Hotman Paris Hutapea assessed that the issues related to the Employment Creation Act (Ciptaker Act) are under implementation.
“My colleagues, lawyers, former lawyers who are now members of the DPR, you know what the problem is [UU Ciptaker] It is compliance or implementation, “he said in the video uploaded to his personal Instagram account on Saturday (10/10/2020).
Hotman gave an example, one of the things regulated in the regulation is severance pay, which is considered very unfair to workers, if there is a problem in it.
According to him, the time to complete severance pay cases could take up to two years, if not regulated in a separate law.
“A worker whose salary is only five million [rupiah] one month, if he is fired and demands compensation, the process is long, in the Ministry of Manpower, in the courts, you can appeal to PK, up to two years. Therefore, a law must be enacted stating that severance pay cases must be terminated within one month, “Hotman said.
It assessed that the speed of handling severance pay disputes is much longer than the handling of bankruptcy issues in the commercial sector, which only takes about 2 months.
“Try to do it that way [satu bulan] in cases of severance pay, there must be justice, “he added.
Since it was enacted on October 5, 2020, the Employment Creation Law has sparked protests from various elements of society, such as workers, students and students in various cities.
