JAKARTA, KOMPAS.com – President Joko Widodo has opened the voice about the wave of rejection of the Employment Creation Law.
After three consecutive days of demonstrations by workers and students to reject the ratification of the law, President Jokowi finally issued a statement on Friday (09/10/2020) afternoon, from the Presidential Palace in Bogor.
Jokowi’s version of deception
President Jokowi explained a number of misinformation and hoaxes about the Job Creation Law, as well as relaying rebuttals.
For example, in relation to the elimination of the provincial minimum wage, the district minimum wage and the provincial sectoral minimum wage are eliminated.
“This is not true. In fact, the regional minimum wage still exists,” he said.

Then, regarding the minimum hourly wage, President Jokowi also emphasized that this was not true.
So the news that all licenses were withdrawn was also not true.
“The license rights remain and are guaranteed,” he said.
Furthermore, President Jokowi denied reports that the company could unilaterally terminate employment through the Job Creation Act.
“Then also the question, is it true that social security and other social benefits are lacking? The truth is that social security still exists,” he said.

Regarding the obligation of companies to obtain environmental impact analysis documents (Amdal), the Head of State also emphasized that this provision was not abolished.
“Amdal still exists. For large industries, it should be rigorous to study EIA, but for MSMEs, it is more emphasized on mentoring and supervision,” he said.
President Jokowi said at the same time that there was news that the Job Creation Act was encouraging the commercialization of education.
“This is not true either, because what is regulated is only formal education in special economic zones,” he said.
Unfortunately, it did not include in detail the articles of the Employment Creation Law and their comparisons with the Labor Law.

President Jokowi emphasized that the Employment Creation Law was necessary to generate investment and open as many jobs as possible.
The Employment Creation Law is also necessary to simplify the business licensing system, which is believed to also prevent corrupt practices.

However, President Jokowi did not respond to protesters’ demands to repeal the law by issuing a government regulation instead of a law (Perppu).
He mentioned that the demo action appeared for misinformation and jokes.
“I see that the demonstration against the Employment Creation Law is basically motivated by misinformation about the content of this law and deception on social media,” said President Jokowi.

He also emphasized that he will soon develop regulations derived from the Employment Creation Law in the form of Government Regulations and Presidential Regulations.
This derived rule is promised to be completed in three months. The president at the same time promised to involve the community in the drafting of these derived regulations.
“Our government opens and invites public opinion and there are still suggestions and contributions from the regions,” he said.
It also welcomes those who reject the Copyright Law to do so. judicial review to the Constitutional Court.
“Our constitutional system does say that. So if there are still those who are not satisfied and refuse, please present a judicial review to the Constitutional Court,” he said.

Furthermore, President Jokowi also failed to mention the articles in the final draft of the Employment Creation Law that the workers protested.
It is known that the representatives of the workers met with the Head of State to explain the articles that are considered harmful to the workers.
This happened when President Jokowi summoned two labor bosses to the Palace on Monday (10/5/2020), or just the day the Job Creation Law was approved.
The two prominent workers who were summoned were President of the Indonesian Workers ‘Trade Unions Confederation (KSPI) Said Iqbal and the president of the Indonesian Workers’ Trade Unions Confederation (KSPSI) Andi Gani Nena Wea.
“We broadcast which articles we consider harmful and which are sure to haunt Indonesian workers,” Andi said a day after meeting with Jokowi.

The Cross Factory Labor Federation (FBLP) also previously found eight items in the Job Creation Act that were considered to potentially threaten workers’ rights.
For example, a Fixed Time Work Agreement (PKWT) that can be continually extended to allow workers to become contract-for-life employees.
Then the article opens up more opportunities for companies to outsource. In the Labor Law, the practice is limited to types of work that are not directly related to production activities. However, the Employment Creation Law eliminates this limit.
So the maximum overtime limit is a maximum of three hours a day and 14 hours a week to four hours a day and 18 hours a week.
In addition, the severance pay that was reduced from 32 times was reduced to 25 times.
