Professor at Gadjah Mada University School of Law (UGM) Zaenal Arifin Mochtar expressed his rejection of the bill Cipta Kerja Omnibus Law It must be accompanied by pressure or pressure from the general public because there are many parties that are disadvantaged by regulation.
“I offer that we should shout together with this law. Maybe civil disobedience or what is the term, please think about it,” said the former director of Pukat FH UGM, in a virtual press conference, on Tuesday (6/10).
Zaenal emphasized that the Omnibus Job Creation Bill was harmful to many people and the environment, benefited investors, ignored human rights, and was too centralist. Not a few local government authorities have lost and become the authority of the central government.
According to him, public pressure must be transmitted continuously, even without the signature of President Jokowi, the bill will automatically take effect after 30 days of being approved in the plenary session of the DPR.
“Although there will be no effect because after 30 days it will still become law, but at least there is a political declaration from the president that can be a strong note for the third process (ratification),” he said.
Zaenal said the process of drafting the Omnibus Law for the Creation of Works was a formal defect. It has been problematic from the formulation, discussion until it was approved in the DPR because it did not involve the maximum public participation.
Furthermore, the final draft of the bill was not distributed to DPR members after its approval in a plenary session.
“So the plenary session is like a blank check,” said the expert in Constitutional Law.
Zaenal said measures could be taken to thwart the Omnibus Law Project for the Creation of Works, that is, by submitting a judicial review to the Constitutional Court. This can be done if the Omnibus Bill has been officially enacted.
“The last resort of course judicial review that must be done, because this law clearly shows that the government and the RPD are moving behind public participation, “said Zaenal.
For his part, the dean of the UGM Law School, Sigit Riyanto, also assessed that the process of drafting and ratifying the Draft Law for the Creation of Work ignored various contributions from academics and politicians.
“This means that the deliberation (deliberation) of the making of the law that we are currently facing shows that there is a problem, and it must be answered critically in the hope that we can correct the existing deficiencies,” he said.
