JAKARTA, KOMPAS.com – The Supreme Court agreed to the request for judicial review presented by the former president of the Democratic Party, Anas Urbaningrum. The sentence Anas should have served was reduced by six years from what it should have been.

“Sentence the defendant Anas Urbaningrum to eight years in prison, plus a fine of 300 million rupees on the condition that if the penalty is not paid, it is replaced by a three-month prison term,” said the verdict of the panel of PK judges, on Wednesday (9/30/2020).

Anas is known to have sent a PK in July 2018. The former president of the Indonesian Student Association previously opposed the 14-year prison sentence imposed by the Supreme Court at the cassation level.

The judge of the Supreme Court of the PK, formed by Sunarto, as president of the panel, was accompanied by judges Andi Samsan Nganro and Mohammad Askin.

However, even though it was removed, PK’s panel of judges continued to impose additional sanctions in the form of revocation of the right to be elected to public office for 5 years after Anas completed the basic sentence.

Furthermore, Anas was still ordered to pay compensation of Rs 57.59 billion and US $ 5,261,070.

According to Andi Samsan Nganro, who is also the spokesman for the Supreme Court, there were errors by the judges that were considered justified. Therefore, Anas’ application for PK was granted.

The following is the journey of the Anas Urbaningrum verdict from the first level to the cassation level:

1. Determined the suspect

Anas was a convict in the case of the Hambalang National Center for Education, Training and Sports School (P3SON) construction project in 2010-2012.

Anas’ involvement in the case stems from a statement made by former Democratic Party treasurer M. Nazaruddin in 2011.

At the time, Nazaruddin was fleeing abroad after being identified as a suspect in the corruption case of the SEA Games athletes’ housing project in Jakabaring, Palembang, South Sumatra.

After that, the KPK began investigating this information and named Anas as a suspect in February 2013.

2. First degree verdict

In late September 2014, a panel of judges at the Jakarta Corruption Court sentenced Anas to 8 years in prison. In addition, he was also forced to pay a fine of Rs 300 million, a subsidiary of three months in prison.

The verdict rendered was much lighter than the charges brought by KPK’s prosecutors. Earlier, the team of prosecutors proposed that Anas be sentenced to 15 years in prison and pay Rs 94 billion and $ 5.2 million in compensation.

According to the KPK, this money is equal to the fee for the project carried out by the Permai Group. KPK prosecutors suspect Anas and former Democratic Party treasurer Muhammad Nazaruddin joined the Permai Group to raise funds.

In addition to passing an eight-year sentence, the panel of judges also ordered the prosecutor to confiscate land in Pondok Ali Ma’sum, Krapyak, Yogyakarta. The 7,870-square-meter plot of land is said to be the result of Anas’s corruption.

3. The verdict on the appeal

After being sentenced in the first degree, through his lawyer, Anas filed an appeal with the DKI Jakarta High Court.

Furthermore, in February 2015, the appellate panel of judges decided that Anas was sentenced to 7 years in prison or 1 year less than the first level verdict.

Jakarta High Court public relations official M Hatta stated that in the appeal decision Anas was still subject to a fine of Rs 300 million, a subsidiary of three months in prison.

However, the land assets in Krapyak that KPK prosecutors had previously ordered confiscated were returned to the pesantren led by his father-in-law Attabik Ali.

4. Verdict on the cassation rate

Despite receiving a lighter sentence, Anas filed an appeal with the Supreme Court.

The request was rejected. The panel of cassation judges chaired by Artidjo Alkostar sentenced the former member of the General Electoral Commission (KPU) to 14 years in prison.

In addition, Anas was also forced to pay a fine of 5 billion rupees, an affiliate of one year and four months in prison.

The Chief Justice Krishna Harahap explained that Anas was also required to pay a replacement fee of IDR 57,592,330,580 to the state.

“If this replacement money is not paid within a month, all his assets will be auctioned. If there is still not enough, he will be threatened with imprisonment for four years,” Krishna said, quoted by Antara. Between.
