JAKARTA, KOMPAS.com – A domestic businessman who is also the son of former President Soeharto, Bambang Trihatmodjo, sued Finance Minister Sri Mulyani because he was related to banning him abroad.

Not accepted, Bambang filed a lawsuit against the State Administrative Court in relation to the Decree of the Minister of Finance Number 108 / KM.6 / 2020 of May 27, 2020 regarding the Stipulation of the Extension of the Prevention of Traveling outside the Indonesian Territory against Mr. Bambang Trihatmodjo to manage state accounts receivable.

As Minister of Finance, Sri Mulyani acted as Chairman of the State Accounts Receivable Committee Team. Bambang’s debt to the state is actually a debt transferred from the Secretary of State (Setneg) to the Ministry of Finance.

Bambang Trihatmodjo’s debt stems from the holding of the XIX Marine Games in 1997. At the time, Bambang Trihatmodjo was the head of a private consortium appointed by the government to host an ASEAN interstate sporting event in Jakarta.

The secretary of the Ministry’s Secretary of State, Setya Utama, explained that at that time the private consortium apparently lacked funds so that it had to be covered by the government. Satya himself did not explain how much debt members of the Cendana family had to pay from the state treasury.

“The consortium is tasked with providing funds for the organization of the Sea Games XIX in 1997. In its implementation, the consortium experienced a shortage of funds and the state granted loans that eventually became the consortium’s debt to the state ( accounts receivable from the state), “Setya explained in his statement quoted on the official website. Regarding the accounts receivable problem, the Secretary of State has made efforts to return the state money to Bambang Trihatmodjo.

These efforts included a series of coordination meetings attended by representatives of the Ministry of State Affairs, the General Secretariat of the Ministry of LHK, DJKN of the Ministry of Finance, the Presidential Secretariat, and the KMP Sea Games XIX 1997.

In these meetings it was agreed that the aforementioned accounts receivable settlement issues would be delegated to the Ministry of Finance, mainly related to the delivery of the State’s accounts receivable management and technical implementation.

“Now the handling of the state accounts receivable settlement problem is in process at the Ministry of Finance until the accounts receivable are declared paid or completed in accordance with the provisions of current laws and regulations,” Setya said.

Sri Mulyani forbidden

Previously, the general director of State Assets of the Ministry of Finance, Isa Rachmatarwata, stated that the decision of the Minister of Finance was made so that the interested party complies with the obligation to return the debt to the government.

According to Isa, preventive measures were taken abroad after the State Accounts Receivable Affairs Committee (PUPN), chaired by the Minister of Finance, called to warn. However, the responsible party did not respond to this.

“In the performance of its functions, the committee must have convened and warned those responsible for paying off the debts. If attention is not paid to it, then the committee will have the authority by law to take further action,” Isa explained in his statement.

“For example, prevent the interested party from reaching abroad, then block the account in question. This can be done by asking the competent authority,” he explained.

Isa also explained that the PUPN request to prevent Bambang Trihatmodjo from leaving the country had been submitted to the General Directorate of Immigration of the Ministry of Law and Human Rights.

The PUPN itself is not only made up of officials from the Ministry of Finance, but also the prosecution, police and local governments.

Isa explained that the delegation of accounts receivable issues was given to PUPN when the ministry or agency (K / L) was unable to resolve the issue.

However, Isa was reluctant to explain the details of the accounts receivable problem that Bambang Trihatmodjo came up with.

“I give you one thing that the problem of accounts payable, the detailed information that includes information that is exempt from notification to the public. We can’t really explain the details, but that’s the rule. We take care of everything, ”he explained.

For information, when launching the PTUN Jakarta website, Bambang’s case against the Minister of Finance was registered under number 179 / G / 2020 / PTUN.JKT. The lawsuit was filed on Tuesday (9/15/2020). The plan is for the preparatory exam agenda to take place on Wednesday, September 23, 2020.

In the case it was written that the plaintiff was on behalf of Bambang Trihatmodjo, while the defendant was the Minister of Finance of the Republic of Indonesia. Meanwhile, in the details of the case, Bambang asked the Finance Minister to lift the ban against him.

The content of the lawsuit, among others, fully granted the plaintiff’s claim and declared null the Decree of the Minister of Finance Number 108 / KM.6 / 2020 dated May 27, 2020 regarding the Stipulation of Extension of Travel Prevention Outside the Territory of the Republic of Indonesia against Mr. Bambang Trihatmodjo (President of the Consortium of Organizing Partners. Sea Games XIX 1997) in the context of the management of accounts receivable from the State.

Furthermore, the lawsuit also asked the PTUN to oblige the accused to revoke the Decree of the Minister of Finance and to sentence the accused, that is, the Minister of Finance, by paying court fees.
