7 reasons why workers reject the Omnibus Law: severance pay and leave rights

Various points of the Omnibus Copyright Law (RUU)Ciptaker) which will be ratified by the DPR in plenary session in the near future is considered detrimental to workers.

Previously, the Council and Government approved this bill at the Level I Decision Making Meeting at DPR on Saturday (3/10) evening. Various controversial provisions that hurt people also color it.

Several protests and actions emerged in reaction to this agreement, one of which was from the country’s workers. They will even go on a national strike if the agreement on the Ciptaker bill continues to be discussed and signed into law.


In fact, it is said that up to two million workers from around 10,000 companies in 25 provinces will carry out national work stoppages located within their respective companies.

The Confederation of Indonesian Workers’ Unions (KSPI) also explained the reasons why various points of the Ciptaker bill should be highlighted and then rejected because it was considered detrimental to workers.

First, the Ciptaker bill removes the City / Regency Conditional Minimum Wage (UMK) and the City / District Sectoral Minimum Wage (UMSK). Meanwhile, the KSPI assessed that the UMK did not need to receive conditions because the UMK value set in each city / district was different.

Supposedly, said the worker, the determination of the increase in value and the type of industry that UMSK received was made at the national level.

Second, cut severance pay from 32 months of salary to 25 months, in which employers pay 19 months and BPJS Ketenagakerjaan pays six months.

Third, a fixed-term work agreement (PKWT) that states that there is no time limit for a contract or a lifetime contract.

Fourth, contract employees and Outsourcing for life, which according to KSPI will become a serious problem for workers. Because it is not yet clear who will pay the Job Loss Guarantee (JKP) for contract and outsourced employees.

Fifth, exploitative or unlimited working hours are considered to be detrimental to the physical and physical time of workers.

Sixth, the elimination of vacation entitlements and vacation wage entitlements. This protest was also delivered by the National Commission for Women (Komnas), which stated that one of the articles of the labor cluster clearly stated that companies are not required to pay wages to workers who take full menstrual leave.

Seventh, there is the threat of loss of pension and health insurance due to a lifetime contract.

In the discussion of this controversial bill, up to seven factions agreed to continue the discussion of the Ciptaker Omnibus bill at the DPR RI plenary meeting on Thursday (10/8), while the other two factions refused.

Meanwhile, the seven factions that passed this bill were discussed at the next level, namely PDIP, Gerindra, Golkar, PKB, Nasdem, PAN and PPP. Meanwhile, the two factions that rejected ratification of the Ciptaker bill were the Democratic Party and the PKS.
