‘You cannot leave the demolished property as it is, you need time here, otherwise it is very fast’; Bombay HC to BMC in the case of Kangana Ranaut [Read Order]


The Bombay High Court, upon hearing Kangana Ranaut’s plea against MCGM’s demolition of his bungalow-turned-office in Pali Hill, Bandra, noted that the Court cannot leave the partially demolished property as it is and the court will begin to hear the Kangana case tomorrow.

After the MCGM officer’s attorney, Bhagyavant Late, sought more time to file an affidavit from Division Judge SJ Kathawalla and Judge RI Chagla noted:

“We cannot leave the partially demolished house as it is. We will start listening to the petitioner tomorrow, he needs more time here, but otherwise, it is very fast.”

Bhagyavant Late is the Designated Official of the Municipal Corporation who together with other officials carried out the demolition of actor Kangana Ranaut’s bungalow on Pali Hill, which he converted into an office. It was implemented as a party in the case together with Rajya Sabha MP Sanjay Raut.

Appearing on behalf of Sanjay Raut, lawyer Pradeep Thorat also sought more time to submit an affidavit as his client is in Delhi to attend the current Parliament session.

Giving time for both Raut and Late until next Tuesday to file their affidavits, Court observed:

“Since the monsoon has started and the bungalow is partially demolished, the hearing cannot be delayed any further, so we will allow the petitioner’s lawyer to begin discussions tomorrow.”

The matter will come out tomorrow at 3 in the afternoon.

Last Tuesday, the court allowed Rajya Sabha MP and Shiv Sena’s chief spokesperson, Sanjay Raut, to be added to the proceedings, as the actor had relied on a video of Raut allegedly abusing her while alleging malice in the action. taken against her by the Municipal Corporation. from Greater Mumbai.

The petitioner has in support of her case that the action taken by MCGM to demolish her bungalow was in bad faith and malicious intent, based on a video clip that records the September 5, 2020 interview with Sanjay Raut, in which she allegedly has abused petitioner. It has also been based on a report concerning the demolition of her bungalow, which is titled ‘उख

Furthermore, the petitioner alleged that Bhagyawant Late in bad faith and malicious intent issued a demolition notice / order and proceeded to demolish her bungalow. Therefore, the Court allowed Bhagyavant Late to be added as a party to the case so that he could defend himself in his personal capacity.
