To this, the first bench of Supreme Court Chief Justice AP Sahi and Judge Senthilkumar Ramamoorthy said the party could not take such a position without challenging the October 31 GO that prohibited such meetings until November 15.
“We would have challenged the GO if the state had rejected our representation requesting permission for the demonstration citing the GO. But the authorities involved have not yet issued orders in this regard, ”Ragavachari replied.
He added that the vehicle (yatra) was going to be moving and there would be no meeting.
Refusing to accept the same, the court said it could not rely on such oral submissions.
Noting that they were analyzing the merits of the case, the court said: “It is open to the state government to approve the order corresponding to the representation requesting permission for the demonstration.”
“If any of the parties to the petitions is aggrieved by said order, they can go to court to challenge it,” said the court and resolved the allegations.
