Three days after The Supreme Court suspended the implementation of the Maratha reserveMaharashtra’s Chief Minister Uddhav Thackeray said on Sunday that the state will raise the matter again in the high court and appealed to the public against holding protests.

“All of us were personally monitoring this case and talking to legal experts about it. We are not short on our arguments. We will go to court again for this, ”the prime minister said while addressing people via videoconference.

“I spoke with the leader of the opposition (Devendra Fadnavis) who is in Bihar at the moment. He has also assured me that he is with the government on this, ”added Thackeray.

He also appealed to the public to avoid protests on the issue.

“I want to tell the public that they can protest but this is your government, we are with you, there is no need to come to the roads. We are putting your voice in the courts, “he added.

A bench of three Supreme Court justices Wednesday referred to a bank of incorporation the question of whether states have the power to exceed the 50 percent reserve limit.

Noting that any deviation from the 50 percent upper limit rule for the reserve was permissible only in “extraordinary situations”, the higher court had said that it is of the “prima facie opinion that the State of Maharashtra has no extraordinary situation is shown for providing reserves to the Marathas in excess of 50 percent ”.

The court said it raises a “substantial question of law” on the interpretation of articles 338-B and 342-A, inserted in the Constitution (102nd Amendment) Act of 2018.

However, the Supreme Court made it clear that the situation of those who have benefited from the benefits will not be altered.

Meanwhile, the state government withdrew his circular that he had issued on Friday ask universities and educational institutions to cancel the admission process “in case the Maratha reservation has already been requested for admission for the 2020-21 academic year.”

A new circular issued by the department on Saturday clarified that the previous instructions were withdrawn as it is awaiting instructions from the Chief Minister’s Office.
