The Supreme Court court led by Judge Arun Mishra will deliver the long-awaited verdict on the adjusted gross income installments related to telecommunications companies on Tuesday at 11:30 am.
Judge Mishra, who became a supreme court judge on July 7, 2014, resigns from office on Tuesday and retires on September 2, is set to deliver key rulings in the case involving deadlines for payment. of AGR quotas by telecommunications companies.
Telecommunications companies have to pay AGR-related fees along with interest and penalties, which is estimated to be around ₹Rs 1.6 million lakh. Telecommunications companies have been interested in an extended schedule to pay their legal fees, in a staggered manner.
On July 20, the high court made clear that it will not hear “not for a second” arguments about the reassessment or recalculation of the AGR-related fees of telecommunications companies that are in approximately ₹Rs 1.6 million lakh.
The higher court had observed that it was not a reasonable proposal to grant a period of 15 to 20 years to telecommunications companies to pay AGR fees.
The higher court, which on June 18 had asked telecommunications companies, including Bharti Airtel, Vodafone to archive their books of accounts for the last ten years and give a reasonable time to pay AGR fees.
The Center had previously urged the high court to grant telecommunications companies up to 20 years to pay installments in a staggered manner.
On June 18, the Center informed the high court that the DoT had decided to withdraw 96 percent of the ₹Rs 4 crore lawsuit for AGR related fees collected against non-telecom power supplies such as GAIL.
In October 2019, the high court issued the verdict on the AGR issue to calculate government fees for telcos, such as license fee and spectrum usage charges.
After the higher court rejected the allegations of Vodafone Idea, Bharti Airtel and Tata Teleservices requesting the revision of the ruling that broadened the definition of AGR to include non-telecommunications income, the DoT presented in March an allegation requesting a payment staggered over 20 years.
