In a dramatic turnaround in the ongoing dispute between Delhi University (VC) Vice Chancellor Yogesh Tyagi and Pro VC PC Joshi, the union government rejected Tyagi on Thursday, declaring that his controversial appointments to the position of registrar were invalid. .

The Ministry of Education (MoE) also ordered DU not to act under Tyagi’s orders until he took office after presenting a medical certificate of aptitude “issued by the competent authority that treated him.”

Joshi would continue to act as director of the university until then.

Joshi and Tyagi had gone head-to-head on Wednesday over the appointment of a new registrar: a confrontation that resulted in the unprecedented situation of three people being appointed Registrars in the course of the day.

Tyagi has been on leave since he was admitted to AIIMS on July 2 under “emergency medical condition.” The government had given Joshi the post of VC on July 17 until Tyagi took office.

The order signals the government’s discontent with Tyagi. The sources said that the Ministry is upset that it was not officially informed of the VC’s absence from office.

“He has not attended the office, and until two days ago he was not fit enough to attend the order of the Parliamentary Committee on the meeting of the Registrar on the welfare of SC / ST. His orders will be valid once he officially resumes his service, ”a senior officer told The Indian Express.

Before the government intervened Thursday night, the power struggle had intensified, and Tyagi issued orders to expel Joshi with immediate effect.

Joshi was replaced by Geeta Bhatt, a member of the BJP-backed National Front of Democratic Teachers and a prominent member of the Group of Intellectuals and Scholars, who had issued a report stating that the Delhi riots were allegedly orchestrated by “jihadists” and “urban “. Naxals ”. The report later became a book published by Garuda Prakashan.

The DU Registrar’s office remained double-locked Thursday. Sources said that both opposing camps had closed it late at night.

On Wednesday morning, a few hours before a meeting of the Executive Council (EC) began, PC Jha was appointed Registrar to replace Suman Kundu, at the urging of Tyagi.

Joshi, however, considered the appointment “illegal” because he had not arrived, and asked Jha to leave the office. Kundu chaired the EC meeting as secretary.

In the evening, the EC had unanimously appointed a third person, Vikas Gupta, Secretary.

Consequently, on Thursday morning, Joshi signed an office order as Pro VC announcing that Gupta had joined as Registrar.

Hours later, however, Tyagi took Joshi away. “In fulfillment of the power vested in the Vice Chancellor … I appoint Dr. Geeta Bhatt, Director of the Non-College Women’s Education Board, as Professional Vice Chancellor of the University of Delhi, in place of Professor PC Joshi … with effect immediate until later orders… Executive Council will be informed, ”Tyagi wrote, on the basis of which Jha issued an official notification.

Later that day, Bhatt issued an office order overturning Joshi’s order designating Gupta as Registrar. She said the order was “in violation of orders” issued by the VC and “without any jurisdiction and legal authority.”

Bhatt wrote: “It is an abuse of the legal process stipulated in the Law, Statutes and Ordinances of the University of Delhi. Therefore, said contested order dated October 22 and any other order / notification / act issued by the then Pro Vice Chancellor, Professor PC Joshi, that is contrary to the University of Delhi Law of 1992 and the orders of the Authority Competent University Professor Yogesh K Tyagi, Vice Chancellor are null and void. “

Interestingly, the letter from the Ministry on Thursday was addressed to Gupta, and not Jha.

The Ministry wrote: “… It has been reported that a Registrar charge notice was issued on 10/21/2020 in the morning even before University working hours without the active knowledge of Prof. PC Joshi, who is the Pro -Vice-Chancellor who currently holds the position of Vice-Chancellor according to the university statute and an attempt was made to block the conduct of the Executive Council meeting scheduled for 10/21/2020 and the operation of the University by the acting Secretary designated by Prof. Yogesh Tyagi, who is on leave. “

The letter went on to state that Tyagi’s orders would not be valid unless he officially joined the post after presenting a certificate of medical fitness, and that Joshi would act as VC until then.

“It can be ensured that the admission process, recruitment and academic activities in light of the current Covid situation can be carried out smoothly on schedule and without delay,” the letter read.
