The dispute over the Sudarshan TV show comes to court; SC and the superior court give different orders


The controversial program on a private television channel that called for a “major exposure on the conspiracy to infiltrate Muslims into government service” on Friday was subject to judicial scrutiny before the High Court and High Court of Delhi.

The Supreme Court refused to restrict the pre-broadcast ban on Sudarshan TV from broadcasting the ‘Bindas Bol’ program, but the High Court, in an interim order, suspended the broadcast of the program that was scheduled for today at 8 p.m. News on the matter came from the high court where a court by Judge Navin Chawla prevented Sudarshan TV from broadcasting its program on the petition filed by former and current Jamia Millia Islamia University students.

It also emerged that the matter was also dealt with by a higher court of Justices DY Chandrachud and KM Joseph, who said that it first has to be prudent in imposing a pre-publication or issuance restriction on opinions. A lawyer said that following judicial discipline and with precedence, the order of the higher court would prevail over the order of the Delhi high court and in all likelihood the matter could be transferred to the high court at the next hearing dates.

The higher court said: “At this stage, we have desisted from imposing a pre-broadcast interlocutory injunction on the basis of an unverified transcript of a forty-nine second clip. The Court should be prudent in imposing a prior limitation on the publication or dissemination of opinions.

“We note that according to the legal provisions, the competent authorities have powers to ensure compliance with the law, including the provisions of the criminal law designed to guarantee social harmony and peaceful coexistence of all communities,” said the court upon hearing the petition filed by attorney. However, before the High Court Defender Shadan Shadan Farasat, appearing before the petitioners, showed a video clip of the trailer that has been released by the television channel of the show and said that the trailer itself shows that the show could be in complete violation of the Program. In the high court, a notice was sent to the Center, the Press Council of India, the Association of News Broadcasters and Sudarshan News.

In the viral clip, the channel’s editor-in-chief, Suresh Chavhanke, had alleged a conspiracy in the “overwhelming” number of Muslim students who passed the Union Public Service Commission examinations and was scheduled to broadcast a large exposition on the conspiracy to infiltrate Muslims into government service. While the higher court has set the next hearing date of September 15, the higher court will hear the matter on September 7.
