Calling the act ‘Absurd’, the ‘Jalebi’ actress’s plea read: “Respondent No. 2 (Rhea Chakraborty) claims that she has presented a strong first-face case against the petitioners and the co-defendant. The same prescription issued by the defendant Dr. Tarun Kumar shows the late Sushant Singh Rajput as an OPD patient at Dr. Ram Manohar Lohia Hospital, New Delhi, when at the relevant time Sushant was in Mumbai, Maharashtra. This makes it clear that the document is forged and fabricated. ”
It further stated: “Aside from whether or not such medication could be prescribed through teleconsultation, there is nothing in the record to suggest that the petitioners in fact arranged for co-defendant Dr. Tarun Kumar to virtually consult with the late Sushant Singh Rajput before prescribing that drug. Regardless of the physician’s ability to prescribe such drug, it was his legal obligation to first consult with the patient, virtually or otherwise, before issuing such a prescription.
“The nature of the messages exchanged between Petitioner No. 1 and the late Sushant Singh Rajput suggests that no such consultation took place, and therefore the defendant’s actions clearly contravene both the Telemedicine Practice Guidelines as those of India. Council (Rules of Conduct, Etiquette and Professional Ethics, 2002). Therefore, it is absurd to suggest that the present accusation is without merit or deserves to be quashed at this preliminary stage ”
The next hearing in the case is scheduled for November 4, after the CBI and the Mumbai police submit their affidavits.
