Actor Sushant Singh Rajput’s sisters, Priyanka Singh and Meetu Singh, moved to the Bombay High Court on Tuesday, seeking to overturn the FIR registered against him by Mumbai police for forgery and procuring false medical prescription for their late brother.

Bandra police filed the FIR against the duo on September 7, based on a complaint filed by Sushant Singh Rajput’s girlfriend and actress, Rhea Chakraborty, who is currently in jail in connection with a drug case related to the death of the actor.

A bench in the division of judges SS Shinde and MS Karnik accepted the guilty plea on Tuesday and then released it for their hearing on October 13, saying there was no urgency.

In her complaint, Rhea Chakraborty accused the sisters of Sushant Singh Rajput and Dr. Tarun Kumar of the Delhi-based Ram Manohar Lohia Hospital of falsifying a prescription for supposedly anti-anxiety medications that were prohibited under the Narcotics and Psychotropic Substances Act. (NDPS) of 1985.

According to the complaint, the drugs were for Sushant Singh Rajput. The 34-year-old actor was found hanged at his residence in the suburbs of Bandra on June 14 this year.

In the petition, the sisters of Sushant Singh Rajput claimed that the FIR was submitted based solely on media reports and that the complaint was riddled with material irregularities and discrepancies.

They also said there was an inordinate 90-day delay in filing the complaint, the medications were prescribed on June 8, the day Sushant Singh Rajput asked Rhea Chakraborty to leave her home, and the complaint was filed on September 7th.

The petition for provisional measures has requested instructions from the Central Investigation Office (CBI), to whom the police have handed over the FIR against the petitioners, not to take coercive measures against them.

The CBI is already investigating a complaint filed by Sushant Singh Rajput’s father, KK Singh, who accused Rhea Chakraborty and her family of instigating the suicide of his son.

“A mere reading of the complaint and the FIR shows that no recognizable crime is identified. The drugs that Dr. Tarun Kumar has allegedly intended to administer are not prohibited drugs,” the petition says.

There is no evidence to show that the prescription drug was administered to Sushant Singh Rajput or anyone else, he said.

There is nothing in the FIR to suggest that the petitioners used the prescription to buy the alleged drugs from a third party or that they induced Sushant Singh Rajput, according to the statement.

This FIR has been filed in a very vague complaint based on alleged conjecture and conjecture with an ulterior motive to incriminate the petitioners (Priyanka and Meetu), he said.

The statement alleged that Rhea Chakraborty was tarnishing the image of Sushant Singh Rajput by suggesting that he suffered from mental illness and was addicted to drugs.
