SC maintains order of Gujarat HC annulling Bhupendrasinh Chudasama 2017 elections | India News

NEW DELHI: The Supreme Court on Friday suspended the Gujarat High Court order annulling the Minister of State and BJP Leader Bhupendrasinh ChudasamaThe 2017 elections for negligence and manipulation.
A bench of judges L Nageswara Rao, Sanjay Kishan Kaul and B R Gavai issued a notice about Chudasama’s request and sought his rival’s response Congress candidate Ashwin Rathod, among others.
Chudasama is currently the minister of law and justice, legislative and parliamentary affairs, education and some other departments in the Vijay Rupani government.
On May 12, the superior court annulled Chudasama’s 2017 election for negligence and manipulation, and also refused to suspend the operation of the order until the removal of his appeal.
The superior court held that the returning officer “illegally rejected” 429 ballots during the vote count, while the margin of victory was only 327.
Congressional candidate Ashwin Rathod had challenged his rival BJP from the Dholka constituency by a margin of just 327 votes in the 2017 Gujarat assembly polls.
