Actress Rhea Chakraborty and her brother Showik told the Bombay High Court that the Narcotics Control Bureau (NCB), which is investigating a drug case linked to the death of actor Sushant Singh Rajput, has no jurisdiction to initiate the investigation, she said. your lawyer Satish Maneshinde. Mr. Maneshinde told the court that the drug case handled by the NCB should have been transferred to the CBI, which is investigating the death of Mr. Rajput.

The court did not approve any order on the Chakrabortys’ bail statements and suggested that the NCB file a response Monday.

The brothers have been charged by the NCB under various sections of the Narcotics and Psychotropic Substances Act (NDPS). Currently in judicial custody, the two had approached the high court earlier this week in defiance of orders from a special NDPS court in the city that had rejected their bail statements.

Maneshinde told a single court chaired by Judge Sarang Kotwal that the Supreme Court, while listening to pleas seeking an IWC investigation into Rajput’s alleged suicide, had ruled that all cases related to the death would be investigated by the CBI.

“The CBI, which is already investigating the death case, is also empowered to investigate cases under the NDPS Act,” Maneshinde said. “Therefore, the NCB should have transferred the investigation to the CBI after the crimes were recorded under the NDPS Act,” he said.

The lawyer said that both Rhea Chakraborty and Showik should not have been booked under the strict section 27A of the NDPS Act, which refers to drug financing and provides a prison sentence of up to 10 years on conviction.

However, the brothers and other individuals arrested in the case have maintained in their bail allegations that the NCB has seized only 59 grams of drugs, which cannot be classified as a commercial quantity and therefore should not have been registered under 27A .
