Kafeel Khan, the Uttar Pradesh doctor jailed under the harsh National Security Act (NSA) for an alleged speech against the Citizenship (Amendment) Act or CAA, was released from a jail in Mathura at midnight on Wednesday.
On Tuesday, the Allahabad High Court qualified his detention as illegal and ordered the government to release him immediately. The doctor’s speech showed no effort to promote hatred or violence, the Allahabad High Court said.

Dr. Khan’s mother, Nuzhat Parveen, said she will finally be able to “see, touch and feel” her son after a long time. “I am very happy that my son is getting out of jail. I will be able to see him, touch him and feel him after a long time,” Parveen said on the way to Mathura jail, the PTI news agency reported.
“My son is a good person and is never against the country or society. Today is also my daughter-in-law’s birthday and we take a cake with us as she is in Mathura,” he added.
Dr. Khan was indicted under the NSA for his speech against the CAA in a talk at the Muslim University of Aligarh late last year. The Gorakhpur doctor from the UP was arrested on January 29.
While he was first charged with allegedly promoting enmity between different groups on the basis of religion, the charges under the NSA were invoked two days after he was released on bail on February 10 this year.
In Allahabad High Court, Dr. Khan’s attorney, Manoj Kumar, said that the grounds for detention (under the NSA) that were communicated to Dr. Khan were in the form of a CD containing the copy of his alleged speech. at the Muslim University of Aligarh. “But no instrument was given to Dr. Khan inside the jail so that he could view the CD. He was not even given a script, so Dr. Khan never knew what the basic accusations against him were,” Kumar said.
Dr. Khan was also suspended, arrested and jailed for his alleged role in the deaths of more than 60 children in a government hospital in Gorakhpur due to alleged oxygen shortages in 2017. In September last year, Dr. Khan stated that a report from the UP government absolved him of all. important allegations, but the state government has denied it.
