PRAYAGRAJ: Members of the family of the Hathras rape victim has filed a petition with the Allahabad High Court claiming that the district administration has illegally confined them to their home. The court has been asked to order the district administration that “family members be released from illegal confinement and allowed to leave their home and meet people.”

Is habeas corpus The written petition, presented by the victim’s next of kin, is included for a hearing on October 8. Om Prakash, who is the father of the victim, along with his mother, two brothers and two other relatives have filed the petition.
The petition alleges that on September 29, the petitioners were illegally confined to their homes by the district administration and since then they have not been allowed to meet with anyone.
It has also been alleged that “although at a later stage some people were allowed to meet with the petitioners, the district administration still does not allow (the petitioners) to leave their home at will.”
In this petition, the petitioners have alleged that they were prevented from meeting or communicating freely, thus violating their right to freedom of speech and expression, as well as the right to receive information.
In the petition, a Surender Kumar, who claims to be the national secretary general of Akhil Bharatiya Valmiki Mahapanchayat, has stated that the petitioners (relatives of the victim) approached him by phone and on their behalf he submitted the petition.
The petition for a writ of habeas corpus is filed with the superior court when a person is illegally detained. During court proceedings, if the court determines that the person is illegally detained, it can order the release of that person.
