‘Problem that will arise somewhere’: Supreme Court notice to Center in petition challenging farm laws


On Monday, the Supreme Court issued a notice to the Center, seeking a response to a petition challenging the agricultural bills passed by Parliament last month. These bills received the approval of President Ram Nath Kovind and became law.

The notice was issued following a petition filed by Rakesh Vaishnav, who represents the Chhattisgarh Kisan Congress.

The three-judge tribunal of the Chief Justice of India SA Bobde, AS Bopanna and V Ramasubramanian issued a notice and asked Attorney General (AG) KK Venugopal to submit the response.

The court noted that no cause of action has so far emerged, but Vaishnav’s attorney, P Parmeswaran, argued that his client had previously approached the Chhattisgarh High Court challenging the ordinance. He asked the Supreme Court to repeal the new agricultural laws, claiming that they surreptitiously repealed local laws in Chhattisgarh.

The bank said: “We will issue a notice, as this problem will surely crop up somewhere.”

Four petitions were listed in court on this issue. In this case, along with AG, the Attorney General Tushar Mehta and ASG KM Natraj appeared.

The three laws passed by Parliament are: Trade in Agricultural Products and Trade (Agriculture and Promotion) Act, 2020, Farmers’ Agreement (Empowerment and Protection) on Price Guarantee and Agricultural Services Act and Essential Products Act (Amendment) 2020.
