No relief for BS Yediyurappa as Karnataka HC refuses to quash denotation case

In a major setback for Karnataka’s Chief Minister BS Yediyurappa, the Karnataka High Court on Tuesday refused to consider his request to overturn a private complaint alleging that he had carried out “ reckless denotation of land ” when he served as senior deputy minister in 2006-07.

Judge John Michel Cunha in his order noted that he cannot accept the arguments presented by Yediyurappa’s lawyer that the FIR be annulled. “To be precise, the entire complaint and the FIR are not annulled. An order in favor of defendant number 1 (Congress leader RV Deshpande) does not benefit the petitioner (Yediyurappa),” the order said.

The order also ordered the Lokayukta court to monitor the investigation ordered by the criminal court regarding the misconduct of public servants, parliamentarians and bailiffs involved in the commission of crimes.

The order further emphasized that the prima facie allegation revealed knowledge to the extent that the petitioner (Yediyurappa) needs to be investigated.

The order also noted that defendant number 1 (Deshpande) and petitioner (Yediyurappa) held public office at different times and in different capacities, and therefore the argument that the private complaint cannot be interpreted as one ” conspiracy “and” general allegation “.

The judge affirmed that the complaint clearly sought to pursue the act of denotification of the land carried out by the petitioner (Yediyurappa) during his tenure as Principal Deputy Minister.

A complaint was filed against Yediyurappa, claiming that while he was Senior Deputy Minister in 2006, he had ordered the illegal removal of reported land for computer parks in and around Bellandur and Devarabisanahalli.

The author, Vasudeva Reddy, had filed a private complaint in the Lokayukta special court in 2013, in which he had stated that Yeddyurappa ordered the denotation of four acres 30 guntas in survey number 49 in Devarabisanahalli and survey numbers 10, 18, 46/1 in Bellandur. Furthermore, he alleged that after denotification, the lands were diverted for residential purposes.
