New Delhi, October 10: The Union Ministry of the Interior issued a notice to all states and territories in the union on Saturday to ensure that the police take strict action on crimes against women. According to the government notice, it is mandatory for the police to register FIR in case of “offense recognizable under subsection (1) of section 154 of the Criminal Procedure Code (CrPC)”.

The law also allows the police to register FIR or “Zero FIR (in case the crime is committed outside the jurisdiction of the police station) in case of receiving information about the commission of a recognizable crime, which includes cases of sexual assault on women

The government ordered the punishment in case an official does not present an FIR in relation to recognizable crimes.
“Section 166 A (c) of the Indian Penal Code 1860 (IPC) provides for the punishment of a public official for failing to register FIR in relation to recognizable offenses punishable under Section 326A, Section 326B, Section 354, Section 354B, Article 370, Section 370A, Section 376, Section 376A, Section 376AB, Section 376B, Section 376C, Section 376D, Section 376DA, Section 376DB, Section 376E or Section 509 in IPC, “the notice said.

In cases related to rape, the government ordered the police to complete the investigation in two months. It is also mandatory for the police to have the victim of sexual assault or rape examined by a registered physician under consent within twenty-four hours from the date of receipt of the information related to the crime., According to Section 164-A of CrPC.
State police can monitor compliance with the order on the government-launched online portal called the Investigation Tracking System for Sex Crimes (ITSSO). It will be available exclusively to law enforcement officers.
This comes days after a 19-year-old girl died in Hathras, Uttar Pradesh, following an alleged gang rape by four upper-caste men. The brutality of the crime shocked the entire country, sparking massive protests led by opposition parties and women activists.
