Maratha Reserve: Maharashtra government files petition in SC about its order to suspend Maratha quota | India News


MUMBAI: The government of Maharashtra has filed an application with a larger court of the Supreme Court, seeking vacation from the apex courtremains in the implementation of Maratha fee in employment and education, an official statement said Monday.
The government’s move comes amid protests by pro-quota organizations representing the community in parts of the state over the issue.

Maharashtra PWD Minister Ashok Chavan called the PNC President on Monday Sharad Pawar here to discuss state governments’ efforts to overturn the Supreme Court’s suspension on the implementation of the Maratha quota in employment and education.
Chavan, who heads the Maharashtra cabinet subcommittee on the Maratha fee, met with Pawar at the YB Chavan Center here.
“We had previously spoken with chief minister (Uddhav Thackeray) the legal issues related to the annulment of the suspension of the Supreme Court on the implementation of the Maratha quota.

“I alerted Pawar saheb about the same today and understood his views,” Chavan told reporters here after meeting with the head of the PCN, whose party is an ally of the state government led by Uddhav Thackeray.
The Supreme Court earlier this month suspended the implementation of the 2018 Maharashtra law granting reservations to Marathas in education and employment, but made it clear that the status of those who have benefited from the benefits will not be affected.
A bench of three judges headed by Justice LN Rao had referred to a larger constitutional court, to be established by Chief Justice of India SA Bobde, the set of allegations challenging the validity of the law granting reservations to the marathas in education and employment.

The higher court had said that the status of those who already benefited from the 2018 law will not be altered.
The Socially and Educationally Backward Classes Act (ESCB) 2018 was enacted to grant reservations to people from the Maratha community in Maharashtra on jobs and admissions.
The Bombay High Court, while upholding the law in June last year, held that the 16 percent reservation was not justifiable and that the quota should not exceed 12 percent in employment and 13 percent in admissions.
