Following the Ayodhya Ram temple case, a petition calling for the removal of a mosque near Krishna Janmabhoomi or what is said to be Lord Krishna’s birthplace in Mathura of Uttar Pradesh was dismissed by a court today.
A petition filed in a civil court in Mathura last week sought to “reclaim” Krishna Janmabhoomi, alleging that the Mughal Emperor Aurangzeb had destroyed a part of a temple on the site believed to be Lord Krishna’s birthplace. He requested that a mosque be removed next to the temple. The court refused to admit the lawsuit, citing a 1947 statute prohibiting litigation altering the status quo at any religious venue; the law, the Places of Worship (Special Provisions) Act 1991, had exempted the dispute over Ayodhya’s property.
“Every inch of the land … is sacred to the devotees of Lord Shri Krishna and the Hindu community,” lawyer Vishnu Jain said in his lawsuit requesting 13.37 acres of the site, including the part where the Shahi Idgah Masjid is located. The lawsuit claimed that Lord Krishna was born in the “Karagar King Kans (jail) “and the whole area is known as”Katra Keshav Dev”
“It is a fact and story that Aurangzeb ruled the country from 1658-1707 AD and, being a staunch follower of Islam, had issued orders for the demolition of a large number of Hindu religious sites and temples, including the temple found in Lord Krishna’s birthplace at Katra Keshav Dev, Mathura in AD 1669-70, “read the lawsuit filed on behalf of” Bhagwan Sri Krishna Virajman. “
The lawyer said that “the Aurangzeb army managed in part” to demolish the Keshav Dev temple and the structure built there was called the Idgah Mosque.
He also said that an agreement reached in 1968 between Shree Krishna Janmasthan Seva Sangh and the Shahi Masjid Idgah administration to avoid each other’s sections was illegal.
The “Krishna Janmabhoomi” petition was dismissed one day when another court acquitted all 32 accused of criminal conspiracy in the demolition of the Babri mosque, including top BJP leaders LK Advani, Murli Manohar Joshi and Uma Bharti.
The 16th century Babri Mosque in Ayodhya was torn down on December 6, 1992 by thousands of activists or “Kar Sewaks” who believed it was built on the ruins of an ancient temple that marked the birthplace of Lord Ram. After tearing down the mosque, many of the activists chanted slogans of “Ayodhya is just the beginning, Kanshi and Mathura remain.”
Last November, the Supreme Court handed over the site claimed by Hindus and Muslims for the construction of a Ram temple and ordered that Muslims be given an alternative site for a mosque.
