The demolition of part of actor Kangana Rananut’s office in a Mumbai bungalow by the city’s civic body “is nothing but malice in law,” the Bombay High Court said today, canceling the notice upon hearing the petition of the actor against the demolition in September. . In a great victory for the actor, Ms Ranaut will also be compensated for the damage caused by the demolition.
The Brihanmumbai Municipal Corporation or BMC demolished a part of Ms. Ranaut’s office in a bungalow on Pali Hill in Mumbai on September 9. The actor alleged that the civic body’s action against her was the result of her comments against the Maharashtra government and the ruler Shiv Sena. .
The “same party” is also the ruling party in the BMC, the “Queen” actress said in her petition, without naming Shiv Sena, who heads the civic body of Mumbai, India’s richest municipal corporation.
“MCGM (Greater Mumbai Municipal Corporation) has proceeded on unlawful motives, against the rights of citizens. It is nothing but malice in law,” said a division bench of Justices SJ Kathawalla and RI Chagla. The court also said that it does not approve of authorities using “muscle force” against any citizen.
“The way in which the action was carried out leaves no doubt that not using the S.354 was more sinister and prevented him from filing an appeal,” the Superior Court said.
The court, however, noted that the petitioner (Ms. Ranaut) should show restraint in airing her views on the government.
The Mumbai civic body claims that the bungalow contains illegal constructions.
The BMC listed 14 “violations” in Pali Hil’s bungalow, which included a bathroom apparently built in a space marked for a kitchen and an office installed in an area designated for a bathroom.
On Ms Ranaut seeking compensation of Rs. 2 million rupees from the municipal agency for what she called an “illegal” demolition, the court said it was appointing an appraiser who would hear the petition and the civic body on the monetary damages they caused due to the demolition. “The appraiser will approve before March 2021 the corresponding orders on compensation,” the court said.
Welcoming the court’s decision, Ms Ranaut tweeted: “When an individual opposes the government and wins, it is not the victory of the individual but the victory of democracy. Thanks to all who gave me courage and thanks to the They laughed at my dreams. It’s just because you play a villain so that I can be a hero. “
The High Court had stopped the demolition on September 9 in a great victory for the actor. The demolition, the court noted, was occurring “when she is out of state, ordering her to respond within 24 hours, and not granting her more time, despite the written request …”.
Kangana Ranaut has been in the midst of controversies this year due to an ugly confrontation with the Mumbai police and the Maharashtra government over their criticism of the Sushant Singh Rajput investigation.
Things escalated dramatically after her comments in September about feeling unsafe in Mumbai and comparing the city to PoK, with the actor accusing the civic body of targeting her for her comments.
