Mumbai High Court heard bail requests filed by actor Rhea Chakraborty, his brother Showik and others arrested in a drug case related to the death of actor Sushant Singh Rajput on Tuesday.
During the hearing, the lawyer for the alleged drug dealer Abdel Basit Parihar, who was arrested by the Narcotics Control Bureau (NCB), asked the court how the link of the drug supply to the Rajput can be proven now that he is dead.
At Parihar’s bail filing in Bombay High Court, lead attorney Taraq Sayed said that on August 28, Abbas Lakhani and Karan Arora were arrested by NCB with 13 grams of ganja (cannabis) in their possession and given to them. granted bail. Based on his statements, the agency arrested Abdel Basit Parihar on September 3. Kaizan Ebrahim and Zaid Viltara were also arrested.
Sayed reminded the court that the aforementioned individuals were arrested and questioned based on a single submission that the Rajput used drugs. However, nothing has been recovered from the five bail applicants: Rhea Chakraborty, her brother Showik Chakraborty, the Sushant household helps Samuel Miranda and Dileep Sawant, and Abdel Basit Parihar.
Appealing for bail on Parihar’s behalf, his lawyer said that in cases where crimes are punishable by a maximum penalty of one year in jail, such crimes must be considered eligible for bail under the NDPS Act. of Narcotics and Psychotropic Substances, 1985). .
“If the recoveries are small amounts, then those crimes are bailed out,” Sayed said.
“What is the material to prove that my client Parihar delivered a contraband to a person who took it further? In none of the statements have they shown that the amount is more than a small amount, ”said Parihar’s lawyer, cited by Bar and Bench.
As Sayed noted in the chronicle of arrests made on the drug link, he said: “There are two conspiracies, two groups of people: 1) There are people directly linked to Sushant Singh Rajput, and 2) There are people who have been arrested by the names given. for the defendants, like my client (Parihar) “.
“Sushant Singh Rajput expired on June 14. I’m not admitting there was a conspiracy. It expired on June 14 and they are accusing us of supplying him with drugs when he was alive, ”he said.
The lawyer asked how the crime can be proven today, when the Rajput has passed away.
“How can the crime be proven today, when the man (Sushant Singh Rajput) no longer exists?” Sayed said in Bombay High Court during the bail hearing.
“Can a conspiracy charge be greater than the crime? When a crime is liable to be bail, and the defendant appears before the Magistrate, we are never charged with crimes other than bail, “he said.
The Narcotics Control Bureau (NCB) is investigating a drug link in the death of Sushant Singh Rajput and has so far arrested a dozen people.
In its response, the NCB told the court that the investigation had nothing to do with the Rajput’s death and that it was a “drug distribution” case.
“Throughout the arguments, the applicants claim that this is related to the death case of Sushant Singh Rajput, but this investigation has nothing to do with it,” ASG Anil Singh, a lawyer for NCB, told the court, quoted by ANI.
The anti-drug agency also said that all the people arrested in the case are interconnected with each other and that there were regular links and drug purchases.
After a day of hearing, the Bombay High Court reserved its orders on the bail statements.
