New Delhi: The Delhi high Court on Wednesday refused for the time being, to order resumption of underground rail services in the national capital, saying adequate public transport has been authorized to be operated by the AAP government to the general public.
A bench of Judges Hima Kohli and Subramonium Prasad said as and when the blockade is more relaxed, Delhi Metro Rail Corporation (DMRC) shall also be authorized to operate as per directions that may be issued by the Centre of the AAP and the government.
The high court said that once the metro services resumed, DMRC must ensure that the social distancing is maintained since it “has become the lifeline for the citizens of new Delhi and NCR region and, invariably, the compartments are filled to the gills, which can be dangerous in the current COVID-19 pandemic situation”.
The petitioner, Shreesh Chadha, a student of law, had contended that while the Centre and the Delhi government allowed government and private entities for the function and also allows the use of cars and two-wheeled vehicles, they forgot that a large number of people in the national capital, depend on public transit to go to work.
The petition had sought that the public transportation is allowed to operate in the national capital “in strict compliance with the social distancing and disinfection and sanitation rules”.
On the last date of hearing, the high court had observed that the Center of the 1 of May notice that allows private offices to run, with 33 percent of the force, discriminates against those who, without your own vehicle as there is no provision for these people to go to work during COVID-19 security lock.
During the Wednesday hearing through video-conferencing, the Centre said that the bank and the new lock of guidelines, certain activities, such as the metro services are prohibited throughout the country.
“However, the activities that have been permitted with restrictions in the containment of the areas, includes Intra-state movement of passengers and buses, as may be decided by the concerned States and UTs,” the Center reported to the court.
The Delhi government told the bench that has allowed the plying of auto rickshaws, e-rickshaws, cycle-rickshaws, taxis/cabs with a limited number of passengers, and “Intra-state movement of DTC as well as cluster buses has been permitted with the condition that not more than 20 passengers will be allowed at the same time inside of the bus.”
However, the petitioner’s lawyer said that DMRC be directed to operate the Metro train in Delhi, in the first as it is causing great inconvenience to the general public.
The bank disagreed with the statement, saying: “We may note that there has been only two days since the new regulation has entered into force. It is too early in the day to learn the attorney for the petitioner to urge that there is an inadequate supply of public transport to insist that the respondent DMRC should be directed to operate the Metro train in Delhi immediately.”
“From now on, that is appropriate for the public transport that has been authorized to be operated by the Government of NCT in order to comply with the requirement that the public in general.
“As and when the blockade is more relaxed, the respondent DMRC shall also be authorized to operate the Metro train in terms of the instructions that can be issued by the respondents, subsequently,” the bank added. PTI HMP SKV RKS RKS RKS
