The Haryana Assembly passed a bill on Thursday to reserve 75 percent of private sector jobs in the state for Haryana residents amid objections not only from the opposition, but also from a JJP lawmaker, which is part of the ruling alliance led by the BJP.

Once signed into law, the Haryana State Local Candidate Employment Bill, 2020, was a promise made by the JJP before the 2019 State Elections, it will apply to businesses, partnerships, trusts, partnerships. limited liability company, partnership companies, etc. located throughout the state.

Maruti Suzuki India Chairman RC Bhargava told The Indian Express: “Both the IIC and Maruti had stated (to the authorities) when this draft proposal was published that this is not something that is of interest to the industry. As a result, Haryana may lose investments. We stand behind our previous booth. We believe that it will affect the competitiveness of the industry ”.

The bill states that “every employer shall employ 75 per cent of local applicants with respect to positions where the gross monthly salary or wages do not exceed rupees. 50,000 or as notified by the government, from time to time. Provided that the local candidates may be from any district in the State, but the employer may, at its option, restrict the employment of local candidates from any district to 10 percent of the total number of local candidates. “

It was opposed by JJP MLA of Narnaund, Ram Kumar Gautam, who called it “ridiculous legislation” and “100 percent wrong”.

“You can make any number of laws. But the fact is that to harvest crops, even today we have people from Bihar and other states. Rather, the people of Haryana spend six months a year protesting and destroying the industry. Why do you want to make such laws? This whole country is ours. If a brother comes from any other state to work, how can you stop him? Tomorrow, if our children go to another state, they will not be allowed to work there. Where will our children go in that case? I do not agree with that at all, ”Gautam told the House.

Despite objections, opposition and demands to withdraw or amend certain clauses of the bill, it was approved by the majority enjoyed by the BJP and JJP in the 90-member House.

The bill states that a designated portal will be created in which local candidates and the employer must register and that “no local candidate will be eligible to take advantage of the benefit unless they register themselves on the designated portal.”

Opposing the bill, opposition leader Bhupinder Singh Hooda objected to the clause that the industry will have discretionary power to employ at least 10 percent of its employees per district.

“There is already a similar clause that was introduced during our term. HSIIDC does not grant authorization to any industry unless the industry provides an affidavit that it will employ people from Haryana. How can another bill be introduced unless we remove that clause from HSIIDC? How will the government do that? I strongly oppose this 10 percent restriction … the government should make a blanket reservation of 75 percent and remove the 10 percent per district clause, ”he said.

Responding to Hooda’s objection, Chief Minister Manohar Lal Khattar said: “It is correct that such a clause exists in HSIIDC. It has also been there during our six year tenure. But the fact is that it was not adequately monitored during the term of any government because it was not a legislative clause. When we started to monitor it, we discovered that it is necessary to make it a legislative clause. We must also protect the interests of the industry. “

Citing examples, Khattar said: “Maruti had already moved one of their facilities out of Haryana. In fact, Maruti wanted to get all of her plants out of Haryana. They told us that the people of Haryana do not suit them. But we had conversations with them. I assured them that whatever difficulties they face, we will take care of it. A few days ago, Honda also highlighted this problem. Yes, we have left it up to the industry that they must hire at least 10 percent per district, but the remaining employees can be from across Haryana. We can check the records of any industry in Gurgaon and Faridabad and find out how many employees from other places work there. We will find that the maximum workforce is from other states. “

“We get two things from the industry: income and employment. Today, thanks to GST, we do not get any income except for added value. GST goes to the place where the product is consumed. The allure of industry income is no more. There’s just one charm left … because of the industry, the people of our state will get jobs. There are 22 districts, 10% of each district. It will add to 220 percent, ”he said.

“We are only giving the industry the discretion to keep at least 10 percent of the same district. It is up to the industry to employ more people from the same district. There is no upper limit, ”he said.
