MUMBAI: Deputy Police Commissioner Sudhir Jambavdekar, in his capacity as Special Executive Magistrate, has issued a Notice of Show of Cause to Republic TV editor-in-chief Arnab Goswami asking why you shouldn’t be asked to execute a bond of good conduct. If you violate the bond, you would have to pay a fine of Rs 10 lakh. Goswami has been asked to appear before the ACP on October 16.
The notice is issued under Section 111 of the Criminal Procedure Code (CrPC) which asks a person to post a good conduct bond under certain conditions. This provision is invoked for the crimes stipulated, among other articles, in Section 108 (1) (a) of the CrPC, which empowers an executive magistrate to issue a justifying notice as to why a person accused of crimes against public order she must not be ordered to post a bond, with or without bond, for her good behavior for a period not exceeding one year.
The notice comes in the light of two criminal cases registered against Goswami for offenses under Sections 153A and 153B of the Indian Penal Code for alleged violation of public tranquility and “promoting enmity between different groups on the grounds of religion, race, place of birth, residence, language, etc. and perform acts detrimental to the maintenance of harmony. ” The notice sets out details of the two FIRs against Goswami. The first says that he allegedly made inflammatory statements on April 21 regarding the Palghar lynching case, inciting communal hatred. statements have created communal discord, The second refers to the news broadcast by the large crowd gathered outside the Bandra train station on April 14 during the shutdown. The news tried to cause a rift between the communities, thus affecting the peace in town, the notice said.
