Drug Case: Showik Chakraborty Moves New Bail Request In Special NDPS Court


Showik Chakraborty, brother of actor Rhea Chakraborty, filed a new application for bail with a special court in Mumbai in connection with a drug case related to the death of actor Sushant Singh Rajput. Chakraborty, in his request for bail filed on November 3, pleaded not guilty, alleging that he had been falsely implicated in the case despite the fact that no drugs or psychotropic substances were seized.

The Narcotics Control Bureau (NCB) had arrested Showik, his sister, and others under various relevant sections of the Narcotics and Psychotropic Substances Act (NDPS) in connection with a case arising out of the investigation into Sushant’s death. Singh Rajput.

“In the facts and circumstances of the present case, given that no commercial amount has been alleged with respect to the applicant, there has been no recovery from the applicant and that all the allegations refer only to small amounts, the embargo imposed by Section 37 of the NDPS Act of 1985 would not be applicable, ”said the bond request.

He said that a reading of the pretrial detention requests of all defendants arrested in the case makes it clear that there is nothing in the record to suggest that the present applicant is involved in any way with financing, illicit trafficking and / or the offender’s shelter in connection with any narcotic or psychotropic substance.

“Aside from allegedly procuring the drugs for the late actor, there are no allegations against the applicant of being involved in any other form of illicit trafficking or even purchasing drugs for someone else. Therefore, qualifying the applicant as part of a “drug syndicate” or having financed the “illicit trafficking” of drugs is totally unreasonable and without application of the mind, “he said.

“There is not a shred of evidence linking the applicant to the funding of illicit trafficking or the harboring of criminals and therefore the ingredients of Section 27A of the NDPS Act of 1985 are not established in the current facts and circumstances “he added.

Showik claimed that Sushant used him, his sister, and members of his household staff to facilitate his drug addiction while ensuring that he did not leave a paper trail of his own in the form of electronic evidence.

“There is electronic evidence showing that the plaintiff’s sister was in fact doing everything she could to rid the late actor of his drug addiction by constantly restricting the amount of drugs he had access to. The plaintiff’s sister also discussed her concerns regarding the late actor combining his drug habit with prescription drugs with his doctor, namely Kersi Chavda. Previously, a special NDPS court had rejected Showik’s request for bail in the matter, after which it was challenged in the Bombay High Court, which was also rejected.
