Deny Farm Bills With Their Own Laws: Sonia To Cong-Ruled States: The Tribune India

A day after President Ram Nath Kovind gave his consent to controversial farm bills, Congress Speaker Sonia Gandhi on Monday called on her party-ruled states to deny core laws related to agriculture by passing their own laws.

“The President of Congress has advised the states governed by Congress to explore the possibilities of passing laws in their respective states pursuant to article 254 (2) of the constitution that allows state legislatures to pass a law to negate the laws. anti-agriculture centrals that invade state laws, jurisdiction under the Constitution, ”said the AICC general secretary organization, KC Venugopal.

Sonia Gandhi has told congressional states that enacting their own laws would allow the unacceptable anti-farmer provisions in the three “draconian farm laws” to be overlooked, including the abolition of MSPs and the discontinuation of CMPAs in states governed by Congress.

He said that this would also relieve farmers of the grave injustice committed by the NDA government and the BJP.

Describing the logic behind the move, Congress Leader Jairam Ramesh said: “As Finance Minister Arun Jaitley succeeded in getting states to turn to article 254 (2) of the Constitution to override the provisions of the 2013 Land Acquisition Act, a law that he had fully supported as the opposition leader in Rajya Sabha. So states should now follow the same advice to repair the damage caused by farm laws that have become laws. “

Ramesh cited the relevant provision of the Constitution whereby the late FM asked states to override the provisions of the 2013 land acquisition bill.

“When a law enacted by the legislature of a state regarding one of the matters enumerated in the concurrent list contains any provision that contradicts the provisions of an earlier law enacted by Parliament or an existing law regarding that matter, then, the law thus promulgated by the legislature of said state, if it has been reserved for the consideration of the President and has received his consent, shall prevail in that state. Provided that nothing in this clause shall prevent Parliament from promulgating at any time any law with respect to the same issue, including a law that adds, amends, uses or repeals the demonstration of law made by the state legislature, ”Ramesh said, citing the Constitution.

Congress believes it has a strong legal basis to go against farm bills, as agriculture, marketing, and pricing are listed as state issues in the seventh appendix to the Constitution that deals exclusively with state rights.
