The Delhi High Court has ordered the concerned authorities to make every effort to locate and bring before it a Hindu woman, who allegedly eloped with a Muslim worker in November and married in West Bengal.
A bench from the division of Judges Vipin Sanghi and Rajnish Bhatnagar expressed shock on 18 December at the casual approach of the Delhi police in failing to register an FIR on the complaint made by the girl’s father and not to verify the Nikahnama.
“This is a total breach of duty on the part of the SHO in question,” the bank had said. “We order the State to make all possible efforts to produce women, since we cannot accept the statements attributed to her, at this stage, as her voluntary statements,” he added.
Station House Officer (SHO) Naraina, who was also present during the hearing, said that no FIR has been recorded since the Nikahnama occurred to prove that Preeti Gupta had married Syed Mustafa. In a query, he said that the Nikahnama could not be verified despite best efforts.
“To satisfy our conscience, we would like to have her presented to us. In case the woman is located, she will be taken to Delhi and kept in Nari Niketan at least four days before the next date so that she is not under the influence of the petitioner or the persons with whom it is said that she eloped and left, “the court had said in its order.
The court was hearing a habeas corpus petition filed by a man requesting the presentation of his daughter, who disappeared on November 7. The statement said that the petitioner’s daughter appeared to have been kidnapped in an organized manner. The plea said the woman is BTech.
The Delhi police have submitted a status report on the prior notification service. According to the status report, the girl is claimed to have married the Muslim man and has also informed her relatives that she does not want to be disturbed and that she is happy and safe, wherever she is.
The petitioner’s attorney stated that the next of kin should receive police protection in the circumstances.
“We order the SHO in question to investigate the aspect of the threat assessment for the petitioner and family members and provide them with adequate security. The mobile phone number of the area’s Beat Constable will be provided to the petitioner and members of the family, and any call that is received from them will be answered and processed without delay, ”said the bench.
The court also transferred the investigation to the AHTU, Crimes Division, immediately after the FIR’s registration. The court also requested to file a status report with the signatures of the DCP in question and listed the matter for an additional hearing on January 4, 2021.
