New Delhi: Delhi police on Wednesday objected to a statement in the Delhi High Court seeking direction for the NIA to hand over the investigation of a case against Tablighi Jamaat leader Maulana Saad for detaining a congregation in alleged violation of the orders intended to contain the spread of the coronavirus.
A bank of judges Siddharth Mridul and Anup Jairam Bhambhani, conducting the hearing via video conference, asked the petitioner to issue the judgments in support of his request to transfer the investigation by the Delhi Police Crime Branch to the National Agency Research (NIA).
The petition, filed by Mumbai-based lawyer Ghanshyam Upadhyay, also sought an address from the NIA to investigate the matter temporarily and the investigation is monitored by the higher court. He claimed that the Delhi police were unable to arrest the leader despite the considerable lapse of time.
Delhi government permanent lawyer (criminal) Rahul Mehra and defender Chaitanya Gosain opposed the guilty plea saying that the Delhi police were conducting the investigation fairly and argued that the petitioner has no locus standi to present the declaration.
The court listed the matter for a new hearing on May 28.
Defenders Subhash Jha and Yash Chaturvedi, representing Upadhyay, claimed that the Delhi Police criminal branch has been unable to track / arrest / arrest Saad despite the considerable time lapse and his photograph published in electronic media.
“It is practically impossible for Maulana Saad to hide for so long and that also in the country’s capital. The performance of the Delhi Police has been pathetic from the beginning and from the beginning. The failure of the Delhi police is explicit in the fact that, despite the situation of blockade and curfew, Maulana Saad was able to organize a gathering of thousands of people belonging to Tablighi Jamaat in the Indian capital ” stated the statement.
Furthermore, he alleged that “from the media reports and evidence collected so far by the Delhi Police Crime Division, it is now axiomatic that Maulana Saad and her henchmen conspired to spread and transmit the coronavirus in different parts of the country, with an oblique and hidden motive to cause massive deaths across the country and thus derail the Government of India to prevent the deadly disease. “
The Delhi Police criminal branch had filed an FIR on March 31 against seven people, including the cleric, over a complaint filed by the Station Officer at the Nizamuddin Police Station here for arresting a congregation of followers of Tablighi Jamaat in Alleged Violation of Orders Against Large Meetings to Contain the Spread of the Coronavirus.
The Execution Directorate has also filed a money laundering case against Saad, trusting links with Jamaat and others.
The allegation alleged that the acts of omission and commission by Saad and his associates / Tablighi Jamaat constitute “terrorist acts / activities” as defined in the Illegal Activities (Prevention) Act (UAPA) and stated that the Delhi Police had not arrested the leader. despite the considerable time span.
He said that the people of Tablighi Jamaat have been spreading the deadly virus across the country not only in defiance of the national blockade, but also by attacking the crown warriors who have been treating patients.
