Judge Navin Chawla’s inquiry came after the central government said it issued an office memorandum on November 18 allowing spas to reopen, while the Delhi government said it would not allow it in light of the third wave of COVID-19 infections in the country. city.

The lawyer who appeared for the Delhi government told the court that he received verbal instructions that the spas would not be reopened in view of the prevailing conditions in the national capital and asked for time to present an affidavit explaining the reasons for the same. .

To this, the court asked: “Why? Why only spas? What is special about spas? You have opened everything else. Look at the markets, restaurants, subways, buses, they are all open and working full time “.

It ordered the Delhi government to indicate, in its affidavit, what was special about spas that were not allowed to open, when everything else was allowed.

During the hearing, the central government told the court that while “it has cleared the covers” for the reopening of the spas, the final decision regarding them was left to the Delhi government.

An allegation was heard promoted by several people who run spas that have been closed since the first closure was imposed in Delhi.

In their guilty plea, filed through advocates Rajeshwar Dagar and Himanshu Dagar, the spa owners have claimed that they have been trained as professional therapists under the National Skills Development Mission launched by Prime Minister Narendra Modi.

Furthermore, they have claimed that when permission to reopen has been granted to a maximum number of businesses, such as salons, gyms, restaurants and bars, and even the Delhi metro has been restarted, then why not spas?

The petitioners have claimed that spas in other states operate with all security measures, but are not allowed in Delhi.
