Maharashtra’s Fisheries and Textiles Minister Aslam Sheikh welcomed the Supreme Court ruling earlier this week on the jurisdiction of the Central Bureau of Investigation (CBI), saying the investigative agency had become a “bread shop” under the BJP government in the Center.
“Under the rule of the BJP, the CBI has become a ‘paan patti ki dukaan.’ It goes anywhere and registers anyone, particularly in states not governed by the BJP. It took action against top ministers and ministers. We give welcome the court’s decision. ” Mr. Sheikh told ANI.
On Tuesday, the Supreme Court ruled that the IWC cannot intervene in an investigation without the consent of state governments and that the Center also cannot extend the agency’s jurisdiction to any state without permission. Justices AM Khanwilkar and BR Gavai referred to the Delhi Special Police Establishment Act which regulates India’s main investigative agency.
“Under the law, the consent of the state is mandatory and the Center cannot extend CBI’s jurisdiction without the consent of the state. The law is in line with the federal structure of the constitution,” the bank said.
The Supreme Court ruling becomes significant with eight opposition-ruled states (Rajasthan, Bengal, Jharkhand, Kerala, Maharashtra, Chhattisgarh, Punjab and Mizoram) canceling the widespread consent for CBI probes in their states in recent weeks. .
The high court verdict on Wednesday was based on appeals challenging a judgment handed down by the Allahabad High Court in August 2019 in a case involving Fertico Marketing and Investment.
