The high court was supposed to consider a report on Rao’s health condition drawn up by doctors at Nanavati Super Specialty Hospital dated November 13, so that it can decide whether to transfer him to the hospital or not.

On this basis, Jaising argued once again that Rao should be immediately transferred to Nanavati Hospital, where a proper medical examination with all relevant tests can be performed. Rao’s lawyers had initially taken to court asking for bail on medical grounds and, furthermore, on humanitarian grounds, claiming that he suffered from numerous ailments, including dementia, and that his continued imprisonment amounted to cruel and inhuman treatment.

Lead defender Indira Jaising, who appeared on Rao’s behalf in the high court on November 12, had pointed to a report from the Nanavati Hospital dated July 30, 2020 (the latest available report on her condition), for a time in the that Rao had been transferred there due to serious medical complications, including a positive COVID test, to emphasize the severity of his condition, and informed the court that there was “a reasonable apprehension that he will lose his life in prison.”
