The Bharatiya Janata Party (BJP) said Thursday that former high court judge Abhay Thipsay’s deposition in the UK Nirav Modi extradition trial is an example of Congress sparing no effort to protect the diamond merchant.
On Wednesday Thipsay made a statement on the legal nuances under Indian law focusing on the inadmissibility of some police statements in the case against Nirav Modi, and the definition of deception under Indian law.
In response to Thipsay’s comments, Law Minister Ravi Shankar Prasad said his statement is legally unsustainable.
“A retired judge is giving a court certificate, his opinion is legally false. This is an attempt to give a misleading defense of a questionable legal variety and we are confident that the legal process will not be affected, ”he told reporters during a web conference.
Prasad alleged that the former judge is a member of Congress, and it was during the mandate of the UPA governments led by Congress that the loans were sanctioned to the companies of Nirav Modi and his uncle Mehul Choksi.
“Who is this judge Abhay Thipsay? He is a retired judge of the Mumbai High Court. Ten months before his retirement, he was transferred by the Supreme Court college for administrative reasons to the Allahabad High Court, “he said.
“After retiring, he joined the Congress party in the presence of Rahul Gandhi, Ashok Gehlot and Ashok Chauhan,” he added.
Prasad further said that Congress did not deny that its former President Rahul Gandhi was present at an event along with Nirav Modi. The event was held in September 2013.
“The company of his uncle (Choksi) [Gitanjali] received benefit when [P] Chidambaram was the finance minister. Gitanjali exports benefited after the results of the 2014 general election were announced, a provisional government made a decision that was questionable, “said Prasad.
The Indian government, he said, is making every effort to ensure that Nirav Modi is extradited from the United Kingdom.
“When the country is trying to bring him back, and the process is underway, a Congressional judge is taking a legally unsustainable stance. The BJP condemns this sinister attempt by Congress to rescue this criminal, ”he said.
Congress dismissed the allegations and said that defenders have the right to appear before their clients.
