The couple, arrested under the provisions of the NDPS Act in a case of alleged possession and use of Ganja, were filed in holiday court on Sunday. In a press release, NCB said that Bharti and Harsh accepted the consumption of ganja.
Special prosecutor Atul Sarpande requested custody of NCB as he said Harsh was found in possession of 86g of ganja, a substance prohibited under the Narcotics and Psychotropic Substances Act (NDPS). The amount was recovered from records at his home and office premises.
But Harsh’s attorney, Ayaz Khan, argued that custody of NCB is not required, as it is a case of alleged personal use at best. And the magistrate did not grant police custody. His statement of bond was filed and will be heard on Monday. Attorney Khan said bail should be posted in the case. He argued that it is not even the case of the prosecution that they were selling drugs.
