A vacation bench by Judges DY Chandrachud and Indira Banerjee said that if state governments target individuals, they must realize that a higher court exists to protect the freedom of citizens.

The court said the Bombay High Court “made a mistake” in rejecting the allegations made by Goswami and these two people seeking provisional bond in the case.
The high court was hearing appeals against the November 9 order of the high court rejecting pleas, including Goswami’s, for provisional bail.
Goswami had challenged the higher court order refusing to grant a provisional bond and asked him to transfer to the trial court for reparation.
They, including Goswami, were arrested by Alibaug police in Maharashtra’s Raigad district on 4 November in connection with the suicide of architect and interior designer Anvay Naik and his mother in 2018 over alleged non-payment of company fees. of the accused.
In addition to requesting provisional bail, the journalist and other defendants had also requested instructions from the higher court to suspend the investigation of the case and annul the FIR against them.
The higher court will hear your pleas seeking to overturn the FIR on December 10.
Goswami was arrested on November 4 at his Lower Parel residence in Mumbai for allegedly instigating the suicide of 53-year-old interior designer Anvay Naik and his mother Kumud in 2018.
At the time of his arrest, Arnab and his wife had been accused of assaulting members of the police team that went to arrest him.
He and the other two defendants were later brought before a magistrate who refused to send them into police custody and placed them in pre-trial detention until November 18.
