> Harish Salve said Section 439 of the Criminal Procedure Code (CrPC) gives special powers to the higher court to hear bail statements. “His (Goswami’s) freedom is at stake,” Salve said.
> A statement of surety was filed with the Alibag magistrates court, but was later withdrawn because the case is a matter for the session court. Local police moved the session court seeking police custody of Goswami.
> “What is the harm if this gentleman is released on bail? What will happen between now and after Diwali? “Salve submitted to the bench, Livelaw reported.
