Actress Richa Chadha files defamation lawsuit in Bombay HC against Payal Ghosh seeking damages for ₹ 1.1 crore


The Mumbai High Court will hear actress Richa Chadha’s defamation lawsuit against Payal Ghosh for “trying to drag her name” to Ghosh’s sexual misconduct allegations against filmmaker Anurag Kashyap. The actor also added Kamaal R Khan and ABN Telugu as parts of his lawsuit seeking Rs.1.1 crore in damages for posting defamatory content against him with a motive to smear his reputation.

On Monday, the matter was brought before Judge AK Menon via videoconference and the lead attorney, Dr. Virendra Tulzpurkar, appeared on behalf of the plaintiff along with attorneys Saveena Bedi Sachar and Sumitra Radhika.

Dr. Tulzapurkar stated that the notification has been delivered to the accused. However, none appeared on behalf of the defendants and the matter was therefore postponed to October 7. The court ordered the plaintiff to serve new notices to the defendants and file an affidavit of service on October 6.

According to the plaintiff, ABN Telugu (Defendant No. 2) transmitted and uploaded to its official YouTube channel, two defamatory videos of his interview with Payal Ghosh that describe graphic details about Anurag Kashyap’s alleged sexual assault on Ghosh in 2013. Furthermore, all The defendants, including Kamaal R Khan (defendant number 3), shared the link to one of the alleged defamatory videos on Twitter.

Although legal notice was delivered to Payal Ghosh and ABN Telugu on September 21, Ghosh granted another interview to journalist Viral Bhayani and an interview to Pinkvilla.com. The complaint says:

The irreparable loss to the plaintiff has been and is continuous in terms of defamation of the plaintiff and damage to the reputation and goodwill of the Plaintiff for the manifestly defamatory and / or libelous content published and / or disseminated by the Defendants jointly and severally, without due care and / or sufficient reason to believe that it is true and has subjected Plaintiff to immense humiliation and ridicule. Plaintiff has suffered incalculable damage and loss to its reputation, as well as He has also suffered tremendous humiliation and stress.

Therefore, the present lawsuit has been filed. against the Defendants in this document for seeking appropriate remedies, including a court order and / or damages for loss caused to the Plaintiff due to the Defendants’ persistent and ongoing defamatory acts, including, among other things, falsely portraying the Plaintiff as a person of relaxed character and moral willing to compromise. for their own benefit. “

The plaintiff has also sought a temporary mandatory court order against the defendants instructing them to remove any defamatory statements / videos against them from their website / channel / social media and also to apologize.

Payal Ghosh has alleged that she was raped by filmmaker Anurag Kashyap in 2013 and an FIR was registered against her at the Versova Police Station under Sections 376 (punishment for rape), 354 (assault or use of criminal force on a woman with intent to outrage his modesty), 341 (punishment for undue restraint) and 342 (punishment for undue confinement) of the Indian Penal Code.

On October 1, Anurag Kashyap appeared before the Versova police station after being summoned and vehemently denied all the allegations made against him. He also provided police with evidence to show that he was not in the country when Ghosh alleged that the incident happened in 2013.
